Can you sue a company you' ve worked at for 2.5 months and still haven't gotten paid yet?
I moved to a new state for a job offer. Last month the computers all of a sudden went down and caused all the employees info to get lost. In the process of installing a new system no one was getting paid but the head people. Everyone else started getting paid slowly but the checks were all messed up. The money from the last 4 pay periods were not even on the checks. Majority of the people got the same amount of money, which is crazy since they all make different salary amounts. None of the head people are ever around to answer for anything that's been going on. It's like they are trying to cover something up. People were just told to give the checks back and have to wait again. What can be done beside quitting if you are already having a hard time finding a 2nd job. You can't pay bills with no money. If you know what to do, I need serious answers please.
Additional Details
I did call the state labor board. Everyone knows how slow the are about handling things. It could be sometime next year before they even try to look into the matter. If no other employee takes action then they won't be able to do much to help my case. They said I had to file some paperwork and they will look into it. I don't have time to wait around on them. I need to get paid. I don't know about them going through any kind of bankruptcy. I have been told that this has happend with this corporation 3 times within the last 5 years.

I would call your state labor board and report them. What they are doing is illegal.

If the computers are down, how come the head people are still getting paid?

Go directly to the state labor board. There is no reason for not having paid any employees. They have all the pay plans and offer letters in writing on paper. They could use those and do manual checks for everyone. And for them to tell the people that did get checks to give the back is wrong. The only thing that comes to my mind when I read this, is that your company is filing Bankruptcy and does not want the employees to know yet. When a company files BK they are not allowed to pay employees or any of their bills until it is approved through the courts because technically the money on hand in the company is no longer theres. It belongs to the BK court and they have the say on what gets paid and in what priority. Sorry.

soem jobs are scams. id research the company and then try to sue them for the money they owe you. Id also get out of it before you get ripped off more

Don't think they can terminate you for suing cuz that would be wrongful termination on top of not being laid I mean paid. Go to handelonthelaw.com, go to the state your case feature, and a lawer might get back to you and let you know what all you might be looking at....
