No. It has been 3 years since you quit therefore you've had plenty of time to go after them. Why did you wait 3 years to consider suing them? If the money was that important you should have gone after them as soon as you were denied your final check.

If your saying 3 years ago they didn't give you your final check then maybe depends on the statute of limitations for your state. But why didn't you go back and ask for it, or ask them now. If they refused to pay you there is an agency in every state that you can complain to and federal law they violated. If you never went back maybe your paycheck sat in the office for awhile, maybe its still there.

Yes, but for small claims stuff like that there is usually a statue of limitations meaning that you only have 5 years to sue them for it, and make sure you have documentation showing that you didn't get paid for it.
