Smoking is not allowed at work, so is chewing/smokeless tobacco? Spitting tobacco juice? Ew.
Don't tell me to take it up with HR, I am HR :)

The difference is that chewing smokeless tobacco is not harming other's health unlike second hand smoke. So you can make a case that it could be allowed as long as the chewer is discreet and not making sounds that would disturb others around him or her.
However, a company can make their own guidelines regarding this habit and outlaw it if deemed necessary. If it is not expressly prohibited however and the chewer is being discreet, I would think you are, by default, allowing it. |

See.. as a HR man, you know that smoking tobacco in a public place may inconvenience others by its "smoke" spreading. Other types do not harm as 'passive smokers'..thus may not be banned. |

Why not? There's no second hand tobacco chew. People spit regular spit all the time. It should be fine. |

Do you have rules against chewing gum? Bad perfume/cologne? You should be allowed to address any "behaviours" that impact workplace morale and productivity, particularly in relation to others. If "he" has an office, he should be encouraged to keep it to himself.
You might also remind of the health risks associated with such behaviour. |

If there's no rule specifically concerning and/or prohibiting chewing and/or smokeless tobacco, then that's pretty much it - it's allowed until a rule is made to the contrary.
Just pay attention to what you're drinking. |

If your HR, you should know the laws?
If ban tobacco, ban all tobacco products.
You should have the cleanest work environment possible, and spit should be avoided. |

Smoking is not allowed where I work but the use of smokeless tobacco is. The reason smoking is banned is because of the carcinogens in second hand smoke. There's no smoke generated by smokeless tobacco so while you may find it distasteful it's not actually causing you any health problems. |
