Maradona-FAN | Covenant not to compete ? |
What does it mean ? |
|

so far everyone has a good idea of what it means but it also means that you are part of a binding employment contract. And that you cannot give out trade secrets under penalty of contractual law if found out, to another comany, if you leave.
My advise to you would be to take a business law course at your local community college to learn more about contracts and convenants.
Good luck and hope this helps. |

It sounds like a contract that probably means that if you leave your job, you won't start your own outfit in direct competition with your current employer. Not seeing the contract, I can't say for sure, but that's what I would guess. |

If the covenant is in a business contract, that means that you and the contract entity agree not to enter into each others' line of business.
In employment agreements, they mean that you agree not to take a job for a specified period of time in the same industry after leaving the employer who required the covenant. In the US, these kinds of agreements are ONLY enforceable of the employee was significantly monetarily compensated for signing the agreement. For example, a valuable salesperson can take a large portfolio of clients with them when they change companies. So it's worthwhile for their current employer to have such an agreement to keep the salesperson from leaving with all their clients and taking them to another company. |

it usually means that if you work for an organization, and then leave them, you will not open or work for a competing business in the same geographic location for a certain period of time. the point is supposed to be to keep 'spies' from working a few weeks or months, learning the business, and using it against the organization. personally, I wouldn't agree to it in most cases, because I have a right to open a business or work for whoever will hire me. However, sometimes competing companies have a covenant where they won't hire the same people within a certain amount of time--for example,. I know two taxi companies in North Carolina that have an agreement with each other that if a driver quits one company, they must have been gone two weeks or more before they are eligible to apply at the other company. |

A covenant not to compete, is a formal agreement asking former employees not to perform similar work within a designated area for a specified amount of time after leaving their original employer. |
