That doesn't surprise me, Wal Mart may be the industry leader, but they are a HR nightmare....they have gotten in trouble for everything possible when it comes to mistreating employees, cutting hrs (to 29 hrs a weeks) so they don't have to pay benefits, NOT promoting females, using items made in sweat shops overseas, as well of a laundry list of other stupid mistakes made to cut costs. It was just a matter of time before they sued the disabled
This sounds just like Wal Mart....trying to get as much money so they dont have to pay the medical bills...while I can see why they may want some of the money back (100K to 200K), it's not appropriate to take ALL the money (470K) and then leave the lady with nothing to pay with for her long term care. The fact of the matter is, she WAS a employee of Walmart when the accident happened, so even though it was an "exception," Walmart SHOULD still be responsible for maintaining her quality of life. It's not her fault she got seriously brain damaged because of the mishap of the trucker...insurance covers those "exceptions" when they happen. For instance, when your house gets flooded, you flood insurance covers the costs....even though the majority of the people for flood insurance typically don't get flooded. If they want that money back so bad, why don't they just increase 2 liter cokes $ .50 for two weeks. I honestly think Walmart should incur all of the cost, because if her husband would have kept his mouth shut about the settlement (that was a dense move), they would have no idea the disabled lady received the 400K. HR Nightmare I tells ya!
Just think from a marketing perspective how great walmart would look if they paid for her care (without hesitation)...for once people would be talking about how generous walmart is instead how it is a evil corporate entity....I guess that why you don't see them sponsoring shows like Makeover: Home Edition...because they are greedy (and their products fall apart...)
There is always a clause written somewhere for companies to "get around" it. Sure it's in the contract, but did anyway make the husband aware of the clause before seeking medical treatment? And is it stated cleary in the document? I promise you, he probably would not have pursue certain treatments if he knew he may not be able to pay for it. Just because there is a "loop hole" in the health insurance, doesn't mean it is just. Whomever ruled for walmart needs to examine the case closer...and see that this is no humane...this lady will never be able to work again, her life is changed, and she's suffered enough brain damage and injuries to where she may not be alive much longer...Walmart can incur the cost...they are TOTALLY going the wrong way about this...hopefully the Surpreme Court will bring some sanity to this situation.... |

Yes, I saw this story this morning. I am horrified that they would be so greedy to want that money and more. I cried when I saw this story. To heck with policy, be a little human even if it hurts your pocket book. In the 60's we used to boycott stores like this. Now people don't have the guts to be what Americans used to be. |

I seen it. She worked at Walmart, but was in a auto accident with some truck a few years back. She had insurance at walmart which covered her medical expenses. They sued the trucking company, got thousands of dollars. Walmart had a clause in their insuance, if she sued & won, then walmart would be reimbursed their medical paid out. Walmart won their money back which is more than what she was awarded from the trucking company.
What surprises me is why didn't her lawyers read her walmart insurance policy before suing the trucking company?? By now, most of us know Walmart craps on their employees wherever possible.
She's in a nursing home, her husband divorced her so she could get medicaid to help pay her bills.
Her lawyers didn't do a thorough job. It's a sad story. |

Yes I did and its too bad that Debbie Shank is disabled. I will drive 35 miles to another town and shop someplace else before I would shop at this second rate thrift shop!
I,m sure where I live Wal-Mart will pull stakes out of my town of 4200 for lack of business(In Wal-Marts eyes.) and I will say Good Riddance! |
