Direct debit- is a company required to tell you when it is to start?
Im arguing with my credit card issuers as i set up a direct debit 2 pay them but they didnt tell me when it was going 2 start leading me 2 end up with a £40 bank charge for going overdrawn when they took they first payment. Are they required to tell me when it will start (obviously i was expecting to get a letter telling me) or is it just my tough luck?

The thing that reallt annoyed me was that i had already paid over the phone for the month that they took the payment so i wasnt expecting them to take one for that month

no they are meant to tell you when they will start taking payments , most companies will inform you how much will be taken about 2 weeks before the direct debit is going to be taken, well my credit card company lets me know and i thought most did.

The direct debit guarantee states this:

"If the amounts to be paid or the payment dates change, the organisation will notify you normally 10 working days in advance of your account being debited or as otherwise agreed."

So I'd say its pretty clear that yes, they do have to tell you unless you've agreed for them not to. Check out the FAQ's on the BACS website, lots of info there.

Normally when you set up such things you and the bank agree a date on which you want the payment to be paid. The direct debit will then come out nearest to that time. I always thought u were told prior that the first payment would come out on ......date and then after that as specified. Im not sure if you have a claim or not. Visit the bank and speak to the bank manager sometimes they can override these transactions and you will not have to pay the charge. If the manager says he cant help then im sorry it is your tough luck.

yes they are meant to confirm to you in writing when it is to start and the date in which they will take it out every month you then have until it starts to advise them if this is ok or not in writing
