I purchased two tracksuits from an ebay seller and as I have a strange body shape the bottoms fit but not the tops so I decided to sell the tops on ebay.
I was asked during their active auction status if they were genuine and as I purchased them for comfort and not the designer name I decided to contact the seller and ask who confirmed they were genuine.I have now had one of the buyers demand a refund as they believe it is a fake, or think I have "washed and ironed it" it was stated in the listing as new, I had never even tried it on as I knew it wouldn't fit and the tags were still attached when I posted it.They are threatening to report me to ebay and "further", I need to know where I stand.I never usually give refunds but have worked hard to achieve my eBay status and do not want to risk losing anything. I need to know where I stand and fast! I said I would refund them but now they want the p&p refund too! I don't see why I should be out of pocket as I had to pay to post it in the Additional Details I just have a feeling as they are blaming me for washing and ironing it that it may be that they have done it themselves! would also like to point out that I DO NOT IRON - EVER!! lol I just can't get the hang of it so wear tight clothes instead! |

If you feel you are in the right, then follow that. Don't refund if you are in the right.
From what you are saying, I personally think their claim is BS, designed to get something for nothing.
The reason I said this, is because they said "I think it is fake, or I think they washed or ironed it".
They should believe one or the other, instead they copied and pasted a generic complaint to you. They are the scammers. |

As I understand it you don't have to give refunds nor exchanges for anything unless it was not fit for purpose. I don't rate Ebay either but you have to decide how much bad feedback means to you. Also the buyer always pay for postage.
No you should not lose your account that easily if you get reported. I believe they do a little investigation first which means contacting you to get your version of events. |

Yes definately refund them. Unfortunately you cannot please everyone and there's some real @sses on Ebay. I've dealt with a couple myself. Did you get a response from the original seller that they were genuine and did you list in ebay that they were genuine. If you did not list them as geniune then the case holds no water, and you're fine. But if you do not want them to leave a negative mark, its up to you. Keep the Money but risk getting negative feedback, OR.... refund them and they could still give you a negative or neutral, but neutral is better than negative. Also if they leave you negative feedback, just comment BACK to them, and make sure you leave negative comments on theirs as well. I hate jerks. |

not much you can do really just maybe refund them then try and sell it again for abit more to make up were you went out of pocket. ensure that they send you the item back first before you refund them. then wait til they leave you feed back then you leave them theres if they leave you bad feed back you leave them it to. on the other hand wots one bad comment and if someone leaves you negative feedback you can write a comment next to it so when people look they can see them both x |

I say get the negative and than rebute it (your allowed a sentence to disput it that can be seen by everyone who views your feedback) BUT if they paid by paypal they can file a chargeback, and while you may end up winning, at the very least it will be a long hassle. So have her send it back, and IF it is in IDENTICAL condition to how you sent it to her, give her a refund, minus what you spent on shipping. Sorry this happened to you |

I have to admit i am not Ebay's biggest fan. They rely on us the customer to put them where they are and in return we are given no help or support and are treated second rate. In short, there isn't actually alot you can do but adhere to the buyers demands. It's rubbish, i know! but any idiot on ebay can complain or make accusations against the most genuine of ebay members and tarnish their online reputation in the process. Meanwhile as ebay doesn't have a telephone customer service utility to appeal or better explain things you will have to rely on ebays good old automated email response system. s*it* (rhyms with white)
I have been suspended from ebay for four unpaid item strikes all given from the same seller for four identical items. Seller wanted me to do a bank wire transfer to some company i'd never heard of despite advertising paypal. Anyways ebay suspended me.....but the point is.......because of the ebay system i would have been better off putting myself in jeopordy and losing money just to keep customer happy and not have a suspended account for 12 months!! |

If the buyer is questioning the authenticity and condition, it's very likely they are scamming you and additionally, you will never make them happy if you are unable to verify the tracksuit's origins. You are better off giving a refund AFTER the buyer sends the item back (at their expense) and it's in the same condition as when you sent it, especially since you sold it NWT.
RETURN SHIPPING: You should know, though, that legally no seller or retailer is obligated to pay for return shipping. I shop online all the time and it's been my experience that most retailers don't, and won't, pay return shipping because it's too expensive to staff, stock, sort, etc.
ebay's return policy is vague and defers return shipping costs between the seller and buyer. Paypal is more specific and states "If PayPal resolves the significantly not as described (SNAD) claim in favor of the buyer, the merchandise must be returned to the seller at the expense of the buyer." And, Paypal does not allow sellers to refund buyers for an amount higher than what the buyer originally paid (final price + shipping). So if a seller sends a refund, it would be a separate Paypal transaction not related to the original purchase.
SIDENOTE: As a seller, I NEVER state I will refund return shipping although I have on rare occasion when it was clearly my fault. And, I will not refund a buyer for the difference if they chose to pay for higher cost shipping. I had one buyer pay over $4 to send an item Priority Mail to me when it was only $1.50 to ship First Class. So she got mad at me for refusing to pay her the extra $2.50. Sometimes you can't win no matter what. |

I would refund the money - but only after they mailed the item back to me. State in the email you send that you will refund the money if the item is in the same new condition - with the tag still attached - that it was when you mailed it to them.
On Ebay it is usually the buyers responsibility to pay for the postage if they want to return the item. Just state in your email to them that this is your policy and it prevents people from trying an item for free.
You might also ask if they would consider keeping the item if you refunded 1/2 of the purchase price. This sometimes makes people happy - especially if they don't want to pay the postage to return the item to you.
The worst that will happen is that you will get a negative feedback and then they will get one from you. :) Then you can see if you can have the negative feedback mutually withdrawn.
Oh ... and you are not obligated to refund the p&p - that is the price for them trying the item.

I would always just refund them , you get idiots like this, better to loose a few quid than get bad feedback.
I think you are by law supposed to give a refund or replacement if asked, I don't know about the return postage cost though.
after refunding them you can 'report unpaid item' which will get your ebay FVF fees back. |
