i sold a phone to someone who now says that the phone does not work in their country because it is "new to the marker" and so they want a refund. Surely he should have determined whether or not the phone would work before they bidded. Will i have to refund?

Do not refund unless they post the phone back to you and you have it in your hand, otherwise they will not post it back, or they will say they have but its mysteriously gone missing in the post.. I dont think you should refund, the phone is not faulty si its not your error.. Sold as seen! |

I would refuse, its not your problem.....why not suggest they just sell it on Ebay themselves ?

Under the doctrine of caveat emptor, the buyer could not recover from the seller for defects on the property that rendered the property unfit for ordinary purposes. The only exception was if the seller actively concealed latent defects.
This puts the onus on the buyer to ensure that the item is what they want. The seller is only at fault if they lied about the quality or the functions etc of the item.
If you have not lied then you are not at fault. |

If you are willing to refund the money, then tell them that you will give them a refund, when you recieve the phone. otherwise get in touch with ebay for help. Hover over help at the top right of the ebay page and click contact us. |

You will have to give a refund and take the phone back. As long as phone does not work and is in good condition, you should have no problems in giving a refund as long as the buyer can return the item to you. |

i would say, send me the phone back (by insured mail) and once i have received it i will refund you, and then re-fund minus postage costs, which they have to cover as its not your fault it doesnt work!
I bet they dont send it back or they'l say we've sent it back but you havent received it-hence the insured mail! |

your best bet is to email ebay.
as they have all the rules the will tell youo wether on not you should.
because you may be getting ripped off by the person with the phone.

Maybe, If they paid with a credit card on Paypal, they might do a chargeback and there is nothing you can do.
They could also open a complaint with Ebay and if they prove their case you might have to refund.
They might give you negative feedback also.
At the same time, they might be trying to scam you.
Ask yourself these questions:
Are they going to send back the phone first?
If I refund first will I get back my phone or another one that really is broken, because they kept the one that works?
Is it worth the headache for XX amount of money in the transaction?
Are there other options I can work out with the buyer?
Contact Ebay through Live Chat and see what your options are and go into the forums on Ebay and see if anyone else has dealt with this type of situation before.

In the end you might be out a few bucks, but hopefully it is a positive learning experience and everything works out!
