Employee Rights concerning EEOC?
My manager is treating me unfairly compared to other employees. I am working at a bank for the past one year and I have seen changes in the way the management is treating me. My productivity rate is nearly 98% which is relatively high compared to other workers but still i am being treated unfairly. Recently, I was called upon for a mistake which i committed relating to some bank account, the manager warned me that if i repeted the mistake in the next 60 days then he will fire me. But while working in the department i realize that my collegues are doing the same mistake over and over again. Morover the nature of their mistakes that they do while creating an account are worse than the one that i was called in for. I believe that i am a hard working employee and that minor errors committed by my collegues in the working place are being ignored by the manager. I am being treated unfairly? what are my rights?. How can the HR help me with this issue? Please Help

I thank everyone for the prompt reply. here are a few more details. As far as treating me differenly goes... the only proof that i have is the people working with me who are making serious errors which are worse than the one that i have made. I work in the department and i see it with my own eyes that they commint errors and that they arent called on for... moreover i am in a probationary period whereupon if i commit an error i will be fired.. but the thing is errors are being committed by everyone in the dept eyeryday and they are been given an opportunity to be corrected... but in my case i am being called upon.. wat are my options?

Based on your side of the story, you are being treated unfairly. But unless there is a discrimination issue involved, the EEOC has no power to help you. You can talk with HR and ask for a transfer to a different department or branch. Your supervisor is keeping the paperwork in order to have you fired, so watch out and be prepared.

HR will probably not help (I am an HR Professional) as our main job is to keep the management in line and out of trouble. If they have already done something discriminatory (i.e. dealing with your mistakes more harshly than others' mistakes are dealt with, you should contact your state employment office's discrimination hot-line. Or you can always go to the EEOC.gov website if you wish to bring a federal complaint.

Due to the court decision on Tues, which limited the rights of employees to file EEO claims in many instances, I recommend you contact someone in the govt (EEOC or state) for assistance.

While union members and government employees generally have some protection from unfair treatment by their employers, and certain forms of discrimination are illegal in any workplace, most workers are employed "at will" and therefore have no rights when they are treated unfairly or terminated without a good reason. American workers have limited legal protection for workplace rights. The legal relationship between employers and employees in this country is based upon the "employment at will doctrine," which presumes that an employee has no right to continued employment and may be terminated at any time by an employer, whether or not there is just cause for the termination. Unless specific statutes have been violated by an employer, employees have no legal remedy for such things as unfairness in performance evaluations, unjustifiable denials of promotions and pay increases, workplace bullying by supervisors and co-workers, intrusions into the personal lives and personal privacy of employees, and terminations of employment without just cause.

You have no proof that the other employees are making the same errors. I would ask to see my most recent job performance, then set up a meeting with your Manager. In a courteous, always professional manner discuss what is bothering you. Try to do more listening than talking. You can learn a lot from what people say and what they don't say, the subtle clues. Watch your attendance, tardiness, length of breaks, lunches. Most importantly, do not discuss your issues with fellow employees. Remain professional, and courteous,.

working in a larger company can be helpful, review the policy for EEOC, I would try and find out why you are being treated differently.Without a motive HR can't really do anything

This isn't an EEOC issue. It may or may not be an HR issue. You can't know for sure that others are making serious errors and not being disciplined for it. You should meet with your manager to get an overview of your performance to make sure there aren't other issues that you're unaware of that are making him view what you see as your single error so seriously. There are errors which are more or less serious, and maybe you don't have the total picture.
