Depends on the local laws. I work in a payroll office that pays people in many different states. In some states, I can just send the employee a letter telling him that I'm beginning deductions with his next check and to have his manager call me if he needs to negotiate on the repayment amount per week. In other states, the employee must agree to repay us----which they never do without some pressure from management.
With a terminated employee, you can contact him by letter and ask for him to refund the extra payments. If the amount is significant and he refuses, you can begin legal proceedings.
There was an article not too long ago about a man who received a few million from a company he never worked for. He had received a job offer, set up the direct deposit paperwork, but then took a different job. The company paid his salary for 5 years without realizing he didn't actually work for them. He was charged with some form of fraud and theft for never reporting or returning the money.
You also want to adjust your tax accounts. Since this employee was terminated and not an employee, you want to reverse all the employer payroll taxes and send him a 1099 for the amounts paid after he was terminated. Make sure you notify any benefits providers of the actual termination date. If he carried company health insurance, it will look like 4 extra premiums were paid. Reverse those and correct the cutoff date.
Also on the accounting side, this type of error reveals a lack of controls in your system. Either HR didn't tell payroll in a timely manner, payroll didn't process the information timely, or the manager isn't checking the report to see who got paid. Or the former employee had a "friend" in payroll who let this happen intentionally. |

They can litigate and force you to spend more than you received on an attorney.
There is some kind of law that protects companies when they make a mistake ( like the bank putting extra money in your account ). It is kinda like, they made a mistake, it wasn't earned.
ALSO: it is possible that they will do nothing, depending upon the size of the company.
It wasn't owed to you, you were very dumb if you spent it ( at least keep it awhile to see if they want it back....gheeez ). You should be in a position to pay it back if they want it. |

the money is not yours it belongs to the company. they can draft it from your account. I'm sure within the company guidelines there is a clause to the effect that if they accidentally overpaid you, they could and would be reimbursed. |

it might cost more to recover than the paycheck's are worth. lawyers are expensive. These things can be dragged out in court forever, the company might threaten but it would be in their best interests to just swallow the debt. |

Depends what the laws are wherever you are, in Victoria (Australia), there's not a lot they can do about it.
They can ask for it back, but they can't legally force you to give it back.
If they were stupid enough not to realise they were paying it to a former employee, I say tough s*** morons hehe |
