kamil_dzwonkowski | Employee parking problem / Does employeer has the right to forbid me from parking on the comp. parking lot ? |
I work for Walgreen's in a very bad area. Our parking lot is huge. There is never enough customers to fill it up. However, the store MGT requested from Employees to park behind the building. 3 cars got broken into already, 1 got stolen. My question is, does the employer has the right to forbid me from parking anywhere on Walgreen promises? Does the Employer has the right to tow my car away, if I park in the front? In the other chain store the MGT had put cameras outside the parking lot, and then forbidden the employees to park on the parking lot. He said that the parking lot is only for customers and he told us to park on the street! (ridicules, there is 20 employees working) What are my rights? Thank you! |

Yes, it is a PRIVATE parking lot. They have the right to determine who does or does not park there. It is not public property. |

Yet one more example of why workers need unions. Oh, well. I think it depends on who owns and manages the parking lot. If Walgreen's is one of several tenants, and the company that manages the stores also manages the parking lot, then I think Walgreen mgmt. is reaching beyond its real authority, as it neither owns or operates the parking lot. However, if Walgreen's owns or leases the parking lot, then yes, it does have the right to make the rules.
Why don't the employees meet and discuss it, and form a small (2 or 3 people) committee to discuss the problem with management? It's a legitimate concern to have sufficient (if not ample) parking for customers. However, sufficient parking for employees is also a legitimate objective. Maybe the answer is to improve the parking behind the building, such as better lighting and video cameras, to help protect employees' vehicles.
You ask, what are your rights? Your main right here is to figure out what you want, and then to open a dialog with management about that. Any good manager would want to know about his/her employees' concerns, and would work to address those concerns, in a constructive, positive way. |

It is doubtful there is a law on the books to cover this situation. It is not an employer's responsibility to regulate how their employees get to work.
As I see it you have 2 options.
Get all the rest of the employees to band together and demand the policy be changed. Be prepared to be the only one willing to stand up when the boss threatens to fire you all. I've seen it happen way too many times.
Or, find a new job.
If you can't get the other employees to stick up for themselves, you are probably out of luck. Sorry. |

I don't think you have any legal "rights" here, except for the obvious one which is quitting and finding a better job, or getting together with fellow employees and presenting a strong voice on the employee parking issue in the hope of encouraging a change to store policies. Could you find a safer nearby place to park or get rides to work in the meantime? |

Does he actually own the place?..or just manage it?...if he's not the owner..and this is really important to you...I would see who is above him in the chain and see what they think. I don't believe it's a law of any kind..but I do know that they don't like employees to park anywhere in the spaces close to the front doors...but they shouldn't tell you to park off of the property...that's a little rediculous. |

It is a bad situation but the employer has the right to impose those conditions. Try to reason with the boss, ask for security cameras but it sounds like a lost cause. It may be time to look for another job. |

what about if they only make certain employees park in the street and others are allowed to park in the parking lot? And, my employer owns over 30 restaurants and they're only doing it to my store and I am pretty sure it is because they do not like the bumper stickers on my car, because they only started doing it when I started working there! Is this not discrimination??? |
