You are an engineer, but you are not working on your company’s Department of Transportation (DOT) project.
One day you overhear a conversation in the cafeteria between the program manager and the project engineer that makes you reasonably sure a large contract will soon be given to the ABC Company to develop and manufacture a key DOT subsystem.
ABC is a small firm, and its stock is traded over the counter.
You feel sure that the stock will rise from its present $2.25 per share as soon as the news of the DOT contract gets out.
Would you go out and buy ABC’s stock?
1. Are you following the rules that are understood & accepted?
2. Are you comfortable discussing & defending your actions?
3. What if everyone acted this way?
4. Are there alternatives that rest on firmer ethical ground? Additional Details please help me.

I think it would be perfectly fine to buy the stock. People buy stocks off of tips and overheard conversations everyday. Be happy you were lucky enough to hear what was said. Just don't be mad if it doesn't go sky high like you anticipate. |

You said you were an engineer, not a stack trader or analyst, so what's the problem? The conversation you heard was in a public area with no reasonable expectation of privacy. You're playing your hunch that what you heard was reasonable and that ABC was in a position to deliver. I fail to see the ethical dilemma. If you were a trader with access to some "inside" information and you used it, you might have a problem, but as you stated it, I see no problem with you investing for your future. |

Over hearing is not insider trading. If you were involved in the project it self then you 'd be in trouble. But when over hearing did you get all the information or bits and pieces. Do your home work, unless it's a very large contract that will last for years the stock may have a short burst then nothing. If you do a quick buy and sale, that may send a red flag up. Or buy the stock well ahead of the project date, a little at a time. Buying and selling of stock of a company you work for or a competitor happens every day.And yes I would buy it. |

Like other's said, You are going on a hunch, and not going on %100 signed and sure results. You're playing the bet that the information you heard will lead to a contract, and you don't know that the contract WAS signed. The project manager might be filling the project engineer with hopes, and nothing real might happen. The Project manager may change his mind and decide company ABC is too small for the job. It's a hunch, and not a guarantee. You're still taking a risk. Whether or not you go ahead and buy is up to whether or not you believe that will go through, and if it will raise ABC's stock. There's nothing unethical or immoral about your hunch. |
