Contracts with Minors and persons of unsound mind are void ab initio with some exceptions:

1. If the contract is for the supply of essentials for the life - basic bread and butter etc.- they are enforceable for the legitimate payments against the assets/estate of such persons.

2. If the contracts entered into are for the sole good of them, they are enforceable by these categories of persons (minors & persons of unsound mind) at their sole discretion.

In the United States anyone under the age of 21 is considered a minor. Any exception of that must be thru approval of the court legal system. This is in regards to the legitimacy of legal contracts.

States do have authority to modify the age of contention of some contracts, such as marital contracts and others that do not conflict with second and third party involvements.

Many states now have modified the age of contention to age 18 but does regulate the types of contracts permissable for this age. You would have to search this information locally and can be found in your local library that receives the updated state statutes annually.

Lending agencies can lend money to anyone of any age, it's their money, but they do take a risk lending money to a minor because the legal system will rule in favour of a minor for feeling the minor was not mature enough to understand the contract agreed to. Again, you must know the age of contention for your state .

There can be no legal contract established between a minor and a person of unsound mind as neither person is recognized as mature enough to understand the legalities.

Both the minor and the unsound mind person MUST have an adult representative over the age of 21 act as primary contractees with clauses in the contract designating the purpose and interest of the minor and the person of unsound mind . The adult representatives are the true responsible parties of the contract established.

Both are "Null & Void". Either of them cannot enter into a contract, if on the date of entering into the contract, they are 'Minor' or 'Insane - "of unsound mind'.

I am in a business law class, and just the other day we learned that any contract entered into by a minor is void. It doesn't matter what contract it is.

You cannot enter into a contract in either case. You have to have capacity which means legal age of majority or capacity of sound mind. If you do not, then legally you cannot enter into a contract. A contract entered into by someone lacking either of these requirements is not valid. I hope this helps, and good luck to you.

If it was witnessed by someone who is "of sound mind" and a solicitor, then it is legally binding. Depending on the nature of the contract the age may have some berring.
