stuff | How can one solve the problem of gyms with rolling contracts that wont let you end the membership? |
I signed up for 1 year. Because the membership rolled over by 1 month, I have to pay for another year.
Additional Details
This all happened back in October! I've cancelled the DD but they still insist I pay for the year. Ive sent about 4 letters explaining that I tried to cancel my membership after the initial year was up, ive moved, i dont have money etc. They are now trying to get the payment with a debt collecting company. |

Legally you have to pay.
However, I would cancel the dd at your bank and write to them explaining that you only signed the new 1 year contract as you felt bullied into it, that you really can't afford to pay for another year as you now have different more important financial responsibiliites.
Don't just cancel and do nothing as some of the more expensive, well to do gyms do chase and actaully get a debt collection company onto you. However if you write them this letter you are not seen as just a drop out, you explain and 9 times out of 10 they wont chase you but they will still send a letter saying no excuses pay up.
You will be fine just cancel dd at your bank and when they ask have you cancelled it with the company say yes.
EDITED TO ADD now hat you have added extra info, you are obv with one of the more expensive ones, you are now stuck I am afraid. You can go to CAB and exlain to them, they have paid financial workers to help with folks debt and probs like this. CAB will get in touch with both the gym and debt collection company on your behalf and ask them to put an end to it, they may agree with cab being involved but at the least you will have o pay an admin fee for the debt collection company as they dont work for nothing and your gym wil expect you to meet that cost.
Most people don't realise that gyms are the worse for getting your money off you, they think they are little they wont chase m but do a runner and they do. |

Write a letter disputing the debt to the Gym and the debt collection agency. Every time they send a reply, respond with a letter disputing the debt.
A debt collection agency cannot collect a disputed debt. The gym would have to go to court and get a judgement to collect a disputed debt. When you send them a letter disputing it, you will be surprised on how fast they respond as they want the dispute to end so they can collect.
As long as the debt is kept in dispute, they are powerless except through a court. |

Call it bull and go to the manager. Throw an unsatisfied customer hissy fit. Write to the better business bureau.
Listen, if they did not give you advanced notice that your membership would be rolling over, you especially have a case. But if they did notify you, or if your contract said it would roll and it was your responsibility to pay attention, then you have little legal recourse. Threatening to alert the media or their bosses though, might make them give you your money back depending on how big the gym company is. Squeeky wheel and all.
Are you intending to stay for a year? What will happen to me on magazine subscriptions is I'll get automatically renewed for a year, but that's only if I intend to have it. After they renew for a year, I call back and say "yeah, I'd like to swtich to another plan", and then they refund me the difference depending. In any case, worth exploring. |
