I fell in a Target in late August 2008 and pain in my leg has worsened and worsened as a result. I didn't think it would be a big deal at the time, and had health insurance. However, now I no longer have health insurance and the pains are getting worse.
In the Target, water was on the tile, leaking from a shelve, and there was no sign indicating it. |

I am part of Target security, and can tell you that we save digital video for 30 days. I think some stores may still use the old CCTV system, in which case they may have video tapes saved, but those might only be kept for 30 days as well. I was hired after my store made the switch, so I can't be sure. Also, if there is a guest incident, we will try and get as much video of it as possible and save it for future reference. However, some people are just not lucky and we might not get video of it at all. You can try calling the store it happened at and asking them, but its been 4 months now, so they probably won't be able to help you. Next time, even if you have health insurance, Target should be notified immediately. |

If you did not file a report with Target at the time, you can pretty much kiss any chance of getting money from them goodbye. You would be unable to prove that you fell at Target. If you did file a report, they would have saved the tapes.
Any time there is an incident, they will save the tapes from that time. By the way, they don't really use tapes any more, everything is digital saved on a hard drive or back up system. |

If you fell at the time, with or without insurance, you should have went to the hospital. No hospital that i no of can deny you of treatment. Once you have the bill, should've called the collection agency, and stated that you are unable to pay, and they would have written the amount due off or make payment arrangements.
Now, statute of limitations (elapsed time to bring a suit) differs from state to state. Some it's one year, two, three or even six years depending on the type. The only type of case without statue of limitations is murder and rape. However, you should seek an attorney, and the attorney may be able to assist in talking to the company to see how long they keep the video for. If you cannot afford an attorney, call legal aid or ABLE. These are resources for low income individuals that cannot afford an attorney on their own. Best of Luck |
