How much notice do you need to give an employee when you have to lay them off. I have under 4 employees?
Business is very slow and I have to lay off one employee. She will be able to collect unemployment insurance so hopefully she will do ok financially. Do I have to give 2 weeks notice?

You need give no notice.
She can collect unemployment if you don't protest her claim. When she signs up, you will receive a letter from unemployment, telling you a former employee has filed a claim. Fill it out and mail it back.

If you have to lay someone off,it is not pleasant. Just do it, get it over with. The longer you wait, the harder it will be.

Would you rehire this person??? Just don't make any promises you might not be able to keep.

It's the decent thing to do, but I'm not aware of any requirement to give notice.

No you can go ahead and lay her off. You only have to give notice if your a union employment or you fall within the WARN Act guidelines (100 employees, mass layoff warnings)

Make sure you don't say "I'm sorry, I have to lay you off." That tells the employee that he/she made a mistake and that was the reason for the layoff.

That would be the nice thing ... but, since it is awkward, you could let her go today, but give her two weeks (or more if you can afford it) of severance pay.

Morally 2 weeks notice would be best, but I don't thnik there is a law that requires a notice for that small of a work force. Are you sure that they will be able to collect unemployment funds?
