How would you handle this situation???
I work for a communciations company & they provide everyone cell phones to use for work purposes. They move people round in my department so that there is always a back up is someone is out, everyone knows all the positions. The cell phone stays at the position, only the employee changes.

On my work cell phone, I've been recieving a lot of collection agency calls for the employee who previously had this phone. Its gotten to where it is 1 or 2 every day. I give them his new number and remind them this is a work phone but they keep calling my work cell phone. I know he is still using his current phone for personal use as well.

The employee these calls are for is one of our boss' best friends & is related to him by marriage. I'm concerned about the hostility that I might get if I bring this up to my boss. I don't think its fair to the other employees or the company that this employee is allowed to use his work cell phone for personal use.

I did let this person know shortly after we swapped positions about the calls & he said "I will take care of it" but obviously he never did. I didn't really expect him to.

Having been in a similar experience in a corporate environment, this is what I would suggest: Report the credit calls to your immediate supervisor, and discuss the situation with them, or with your HR Director. Give the phone number that the credit collectors call from to either one of those individuals, and let them explain to the caller that the employee no longer works at that company, and they need to direct their calls to his home number.

In the meantime, get the name and address of the agency that's calling the cell phone, and the name of the agent who contacts the cell number. Be prepared to write to them and tell them that you are putting them on notice - that the cell phone number they continuously contact you at belongs to a company, and that the employee that previously used that cell phone number no longer works for that company. Ask them to discontinue their calls to that number in their effort to reach the debtor. Be sure to copy the letter to your HR Administrator and your supervisor, explaining to them in another letter that reasoning with the collectors over the phone has not been successful, and this was the next step that needed to be taken. Be sure you have already notified your HR Administrator and supervisor of the calls before any action is taken.

Additionally, a debt collector is allowed one phone call per day to a debtor - they are violating the Fair Debt Collections Act by calling you more than once a day at that number - you may notify the collection agency of this when they call again in addition to letting them know that they have the wrong person.

But if it affects your ability to work, getting all these phone calls, it is a problem. Is there someone in between you can go to? Someone who handles the phones? HR?

Don't say a word to anybody about it.

If you're bothered about it, work your feelings out by being as rude to the collections agent as you want. Get creative. What do you care? Does that fool even know who you are?

Easiest thing to do, just hang up as soon as you know it's them. They'll figure it out eventually.

Does this harm your ability to do your job or just annoy you? I would let it go to voice mail and then ask your boss to listen to the messages. Maybe he will be able to help you solve this problem.

Have you told the employee that the calls are for about them coming in?

I would and tell him to get ahold of the people that are calling and tell them to stop calling number you now have and to give them his new number.

I totally understand about the it is not fair but in time he will hang himself soon enough and in the meantime it will no longer bother you to get the calls.

However, I would also add that if he does not fix this situation that you will tell the boss he is getting personal calls on the business phone.
