terminated unjustifiably by the company. The company stated that I had showed a sexually explicit picture to a co worker from my cell phone. I explained that I don't have pics on my phone, but they terminated anyways, is this not retalation, and do I have a case?
Go talk to a Labor Relations lawyer. The problem is that the company will drag out the court case and it will cost you money for your legal fees. You are best off to move on.

If you have proof and witnesses then yes you have a case. You need to have a way to prove to court that you don't have pictures on your phone, instead of expecting them to rely on your word.

In general, it's the employer's responsability to show just cause in firing employees when facing a wrongfull termination. In saying that, I mean that they would need a written statement or verbal testomony from a co-worker to prove that firing you was justified for why they claimed. You can also claim that the termination was reprisal for reporting your boss as being racist it the coporate office has records of your complaint.

Get a lawyer and make sure your phone does not get ANY pics or else they may say you erased them.

Lisa, if you want to know and to help your understanding of business and how one should act when one is hired. Than call your ex boss office and ask for a short visitation. Be truthuful sincere and and smile a lot. Tell him you are not unhappy with him but you are unhappy the way the situation was handled. Ask him to please explain. This approach will go a long long way toward him and your next job. Always be honest with yourself and others. When one makes a mistake admit to it and go on about ones business.
