farideh | I ordered an item online, the supplier delivered 2 but charged me for 1, is the 2nd item rightfully mine? |
I have informed the supplier that they sent two items by mistake, they took nearly three weeks to respond. I want to get rid of the item as it is taking up space in my home, We haven't been able to find an amicable solution for them to arrange collection so i want to dispose of it.

It is a really large cat climbing tree, too huge for me to have tweo hanging around the house. The supplier wants to pick it up during working hours but i can't be there |

Sssh don't tell them then sell it on EBay..... but if you have informed then they have up to 3 months to collect before the item is rightfully yours (in the UK that is) and you have to prove you have made attempts for the company to pick up the item, i.e copy of letters sent ect ect I am afraid sometimes in a pain in the butt being honest. |

you cannot dispose of it simply, so what the best thing to do is write a letter informing them they have sent the item in error and you have tried to get them to take back the item as it is taking space up.
I would also give them a date they must collect the item by and what you intend to do if its not collected within this time. ensure this is 2 weeks or so in the future so they have pleanty of time.
Now you will need proof of posting so register the letter so, you know they got it.
Once they have recieved the letter, ring them and ask them what they intend to do, and quote the reference number from the post office.
If after the time period they have not removed the item, send them a final warning, again recorded. and inform them that they are liable to any costs incurred.
Keep all corespondance.
Once the final date has passed, arrange for the collection and by a waste company of the item, and get a reciept.
Then invoice the company. If they do not pay the invoice, take them to the small claims court. |

Well technically it is yours because you did inform the company that you received 2 of the items.
Contact the company again and if they do not reply then sell it you have done your part of the deal and they did not follow up.
