Soniya......No matter what ur contract was, the company can't deduct a single penny from ur PF bcoz its ur hard earned money & the employer has willingly contributed his share towards the benefit of the employee & moreover that money will be in the govt treasury. No one except u or the nominee in case of ur death can take that money. So relax, they can't touch ur money. Now since u mentioned that u had signed a bond of 3 yrs, even there ur company cant force u to work bcoz there is no law in India which can bind a person to work with a certain company or for a certain person. In bottomline.....there is no "Bonded Labour" system in India. All they can do is just hold up ur relieving (experience) letter & try to negotiate with on that ground or else they can't go to court with the bond u signed coz it was a "Non-judicial" bond u have signed which has no value in the court. Just chill n stay calm.

it depends on what your contract stated. did you have a lawyer look over the contract first? if not you could possibly be screwed here. since you fell out of your contract that pretty much means its null and void so they can do whatever they feel like however if you had been putting into the provident fund they cant take away what youve put in it but they could however give you back what you put in it (contribution wise) however they are not likley to do that unless theyre really big jerks. on the other hand, there may be a clause that was stated in the contract that you were to only recieve the provident fund AFTER your 3 year entry approval which means basically they can take it and leave you high and dry wether or not you contributed. it really depends on the contract. sorry i couldnt be more help.

No, the company can't deduct a single rupee from ur PF coz its only u or the nominee (in case of ur death) who has the right to withdraw that money. Even if u signed a bond for 3 years, u can leave the company at ur will bcoz that bond wouldn't be valid in court since we have abolished the Bonded Labour system long back as soon as the British left India....lol

No they cannot deduct your PF dues for violation of your contractual obligation.

I have worked for 3 yrs in my last company. Now I want to withdraw my PF, but according to them they will deduct 20% from my PF as TDS. My PF is managed by private Trust. Pls let me know whether it is possible or not????
