I sent a BillPay check through Bank of America, the check was dated 1/4/08, it was cleared 1/3/08.?
They charged me overdraft fees for other transactions. The check was made for and is clearly stating 1/4/2008 but cleared my account 1/3/2008. Am I really responsible?
Additional Details
This was an automated check that was sent from Bank of America, it wasn't hand written. I arranged through BoA's Online Banking for delivery of the day I scheduled. According to them:

"Our Bill Pay service deducts funds from your funding account on the date
you have scheduled your payment to arrive at your payee unless the
payment was sent by personal check."

They deducted it a day earlier than their policy states.

You cannot post date a check and, yes, you are responsible for it.

Since it was an automated withdrawal type transaction, I don't think you are liable for the fees/overdraft. You should be able to get them to fix it for you, go into bank branch and speak to someone.
If you have paperwork check the fine print, but they usually can't send those payments through on the wrong date except if the day is a weekend/bank holiday or something and even in that case it just goes through a day later, not earlier.

I don't know if they can hold you responsible, but I have also had problems with Bank of America. I have been repeatedly charged with a bounced check that was written on someone else's closed account. The check had never passed through my hands. The strangest part was that the account holder didn't even have an account with bank of america. the fees were eventually taken off my account but no one at the entire company was ever able to explain to me how this happened. I filed a complaint with fraud protection and they found the case to be "inconclusive." Sorry to rant. Just wanted you to know that they can be shady. Good luck.

Never hand a check over to someone and expect them to hold on to it. Most ppl will try and cash it. You are responsible. Knowing you didn't have the money to clear the check is a big no

I believe what you are trying to say is that you paid it through your online billpay...not that you postdated a check. Go into a banking center near you and pull up your online banking with them to prove the date that you had it scheduled for and show a copy of the check dated 1/4/08, then look at your account where it was taken out a day early. Sounds like a bank error to me!!

Yes you are responsible; post dating a check does not do anything at all. People write the wrong dates, months and years all the time. That's why if you get your check book stolen you call the bank & they put a stop on all the check numbers, or if someone cashes a check you never signed for, once it's cashed they can get a photo copy of the check to look at it's signature; banks keep all checks on file for 7 years and they have a fraud department to research that.
If you don't have the funds to cover the check you will get a NSF fee on your account it can range from $29 and up, the bank will do one of 2 things pay the check for you, only if you haven't written a lot of bad checks in the past or they will not pay the check and the person you wrote the check to will get a NSF fee for your bounced check and of course still not get there money for the check you wrote. You will be charged the NSF fee for both scenarios a bank will refund 1 NSF fee a year for you on your account as a courtesy if you ask them nicely and then as a courtesy pay the NSF for the other person if they incur one, the person you wrote the check to will let you know if they get a fee. When you write a check you are saying you have the money in the bank. I would recommend call the toll free number to your bank and asking them questions any questions; I worked in a bank call center during college and you sit in a cubicle and get questions all day, it's their job.
