Its a made up word, as far as I can tell only one firm elsewhre uses the word and its a trademark for agicultural products; but we want to use the word as a band name so would file under a different class. How much, per class, would it cost to file the word as a trademark for:
[a] usa inc.
[b] eu inc.
[c] rest of world.

You'll want to be sure the name was searched comprehensively -- if you did a simple internet search, you're really missing a good chunk of information.
For the US, this entails searching the pending & registered Federal and State trademark files as well as the US National Common-Law files.
Here are the fees:
a) FOR THE US:
$325 per International Classification. Yes, there is a lower filing fee of $275 per IC. However, there are limitations to that filing. If changes or clarifications are required on the $275 application, the USPTO charges $50 per time to make changes. This can end up being substantial in that each application ends up in the hands of one individual; how one person interprets an application from the next varies, so it's best to go with the $325 application. This allows you to make any necessary corrections at no additional charges (of course, unless you are adding new classes).
b) FOR EU:
" • for filing a CTM (Community Trademark)application: €900 (~$1063) plus €150 (~$173) for each class of goods and services which exceeds three
• for filing a CTM application by electronic means: €750 (~$886) plus €150 (~$173) for each class of goods and services which exceeds three
• for registering a CTM: €850 (~$1005) plus €150 (~173) for each class of goods and services exceeding three."

c) WORLD WIDE:
There is no one International Registration. There are 2 encompassing filings, one being the CTM (see above) and the other being WIPO (World Intellectual Property Organization).
WIPO pertains to a system of international registration for trademarks. Two treaties, the Madrid Agreement Concerning the International Registration of Marks and the Madrid Protocol, govern this system. An individual who has a connection (be it through nationality, domicile or establishment) with a country in league with one or both of these treaties may obtain an international registration having effect in some or all of the other countries of the Madrid Union. At present, there are more than 70 countries involved. See http://www.wipo.org/. Fees range from 653-903 Swiss Francs.

As of my sources writing: the filing fees for a trademark application are as follows:
$275 per class for a TEAS Plus application that meets the requirements of 37 C.F.R. §§2.22 and 2.23
$325 per class for an application filed electronically using the Trademark Electronic Application System (TEAS)
$375 per class for an application filed on paper
These fees will be charged not only when a new trademark application is filed, but also when payments are made to add classes to an existing application. Check website bellow for further info. Hope this helps! Good Luck! |

THIS IS THE CORRECT WAY
You must go to a county court and have them search the National Archives to see if any such thing has been done, that alone is over $1000. Then you have to apply for a trademak/patent then you must pay to have the trademark/patent secured then about every 5 years you have to do it all over again.

This isn't a very good answer (because I don't know), but when you do it, make sure you do it world wide. My brother had to change the name of a PC game because a guy in America had copyrighted the word. I think the guy spent all his time surfing the web looking for infringements! :) |
