why do i? | I work in a crap restaurant where the servers don't make min wage...? |
i've kept copies of all of my clock out slips, which show the hours and the tips declared. this job sucks at times so bad that it doesn't even equal minimum wage. should i go to the labor board? i think there is a law against this, i just can't find it online. please, any help would be appreciated...

get out of there ASAP. go apply at some upscale fine dining restaurants. just because they dont have an ad in the paper doesn't mean they are not hiring! I work at one and i know that yes, if we don't make min. wage then they have to pay it, but (I could be wrong) that is only because we tip out 1% to the house and they pay min. wage while training. You must look into all resources because privately owned restaurant are not the same. good luck, get outta there anyway! |

If you are not making at least minimum wage when you include tips, your employer is required by law to compensate you the difference, as far as I'm aware.
Other than that, umm, why do you work there then? Restaurant jobs are a dime a dozen in all honesty, find somewhere else. |

Talk to a person with Labour laws and then talk confidentially to your employer. Tell them if they don't give a reasonable wage you're out of there because you can't survive on their pay. |

Sure, you can waste your life fighting all of the little injustices of life, or you can get on with it.
Live and learn. Invest your time into yourself, not in trying to hurt others or show them how wrong they are. They will get theirs in due time.
It is your attitude, your goals, your perseverance that will get you where you want to go. Try to do it with the least amount of disturbance and without stepping on others, but rather offering a helping hand once in awhile, and it might just be a livable world when you get there.
You will get out of this world exactly what you put into it. |

Each State has their own labor laws regarding requiring minimum pay for standard hourly positions and for positions earning tips. Tips are frequently considered 'commission' wages. In that instance, there is no minimum hourly pay required by law. Every State has a telephone number for their Labor Department. Find your States Labor Department online and place a call. |

The typical wage for waiting tables is 2.15/hr +tips. This is not against the law unfortunately. Your best bet is to gain some experience, then ask your manager for hours when the restaurant has more business, or to apply at a different, more popular restaurant. |
