I work for asda stores in. I had only been working there for 9 weeks part time on checkouts and wanted to change departments so I moved onto nightshift. I have now been working there for 26 weeks altogether and have been signed off by dr as so run down.
I just want to see if my work have followed correct procedure as when changing departments I was told by george manager for night shift duties that I could try it out see how i like it etc - I have never been sat down and spoken to bout how im finding my new role, Nor have I had a contract to sign - i have asked for it 3 times and been told by my new manager " its okay Hr manage has it, you dont need to do anything", have never had training on shop floor, how to pull rails and totes ( boxes full of goods)
now that im off i have looked at going back to checkouts but the hours i had have gone only one shift left for 7hours a week which is no good when i had 12.5hrs on checkouts then 15hrs on nights!!
Can they do this.
I am a parent to a small child and need to work to pay bills

it depends what hours is left on checkouts..maybe they got more staff for the crimbo period!!
i use to work at as on checkouts and was only doing about 20hours a week..
speak to your managers if you have concerns |

a company must leagally train you in every aspect of the job, including their customer service policies and health and safety (im refering to lifting the boxes etc).
also you should be reviewed every 3 months, though there is no legal obligation to do this, it common practice in most superstores, i would highly suggest you send your grievance to the hr department, explaining why you are on the sick, and the fact that you have never signed a contract ect, these should be able to sort this situation out |

Sure they can, you got what you asked for.
You must ahve signed some kind of document when you started working there but unless you are contracted a certain number of hours then they can give you exactly what they want.
Even if they were contracted to give you a minimum number of hours, the only reason your role changed was because you asked for it to and the only reason you want your old role back is because you developed a sickness because of your own choice.
Ofcourse they need to find someone else to fill the hours you gave up and ofcourse they can't just get trid of that person on your request.
I wouldn't be surprised if you lost your job altogether if you don't go back soon if you haven't sign a contract. |

It is allowed. It is not illegal. However it seems a little unethical. You will have to try and look for other options. There is always something else available. Don't forget about the idea of starting your own company doing something you love and are good at. |

I would discuss your case with your local CAB , they are very helpful and will either answer your questions or at least point you in the right direction. Hope this helps |

If I have understood the first part of you question correctly.... I think what this will boil down to is the fact that you worked for 17 weeks on night shift. Although you may not have signed a new contract the fact that you turned up for work for 17 weeks and accepted payment for working those weeks will mean that in legal terms you actually accepted the new contract. |

HUH?!?! If you don't like your assignment, ask for another. If they can't or don't provide it, then find another job.
If you only work 15 hours a week, then just find something else. |

As an employee, you already have a contract of employment. The contract is made as soon as you accepted the job offer. The contract does not have to be in writing. What you do not have, is a written statement of the main terms of your contract. This should have been given to you within the first two months of starting work. Speak with your HR/Personnel Officer about this.
Your employer has a duty of care to ensure, as far as possible, your health, safety and welfare while at work. For this reason, your employer must give you information, instructions and training as needed. Speak with your Line Manager about this.
Your employer is not obligated to keep hours available when you change deparments. From what you have said, it does not seem like you employer has done anything wrong.
If you do not feel like you are getting anywhere with your employer - you should take the advice of other respondents and visit your local CAB office.
