If a company i work at takes pictures of me and uses it in an advertisement should i at least have to be told?
can they profit off of my image without telling me. its not like i got hired as a model or something. it was never part of any agreement of being hired. they just took a picture of me while i was working.
Yes, they should tell you what the picture was for. IF they use it in advertising, they should get your agreement ... at least buy you lunch.
At one of my former jobs, they took pictures all the time, but they just used them in my department as a way to make people feel popular. When they wanted to use them for other reasons like the company magazine or outside advertising, they always asked and obtained a release.
Many companies use employees in their advertising. It is often cheaper than paying a professional model. I see ads saying "Come work for us." that use real employees. I see ads on TV or in the newspaper that use real employees to promote the services of the company. I know of one advertisement that used an employee to promote services of a different department than she worked in. That one went around the gossip table for weeks.
The question is how well do you like your job? How easy can you find one that pays as well with the same or better working conditions? How big a stink do you want to make? Do you object to the use of your picture as long as they tell the truth about you and/or the company?
Do you know they used it in advertising or just believe they might? A smart company will keep that person employeed to cover truth in advertising. Call it job security. If they do can you, unless you sign a release, you can demand they cease and desist using your image without your permission.

I'm pretty sure they're supposed to have you sign a release. I doubt if they'd pay you anything for it unless it was a real commercial or something but the release is required.

Probably hidden deep inside your employment contract. If you are uncomfortable with that then discuss it with human resources..
