If u leave work at the the time ur schedule to be off is that job abandonment?
i was suspended for leaving work at my schedule time and it may result in termination also. i was schedule from 9:30am to 7:00pm. the store closes at 6:30pm. i had finished up work ready to go home but there was work left to do one customer came in after 6:30. i work in automotive repair .

Don't sign anything. If they give you a write up sheet or something like it. Don't sign it. You have a case for sure.


Unfortunately, they can terminate you regardless. However, after wards you have options. After the fact, the situation favors you, it appears to be an overreaction on their part. Legal action or unemployment would probably swing your way, assuming you haven't signed anything that could be perceived as an admission of wrongdoing.

If they do terminate you, contact: Unemployment, the Better Business Bureau (or your states equivalent), and a lawyer if you'd like.

You should not be fired or even suspended for this. If the store closes at 6:30 then it's closed. Even if a customer comes in after 6:30 you are still technically closed, and you can politely tell them you are closed and let them know what time you open the next day. If you were scheduled to leave at 7, and you did, unless your company policy specifically says something about staying to work late if a customer comes in, then they don't have the legal right to suspend you.

your employment agreement may have had a clause that said that on occasion you would be expected to work overtime. In which case, they could take action.

If your supervisor told you to stay and you didnt I believe this would be considered insubordination and you could be fired. On the other hand if you didn't know you were supposed to stay and there was no one around to ask, then I would say your are in the right. Unless you have some pre-agreed to arrangement with your employer, I believe it is perfectly lawful for them to make you stay past your scheduled off time.

If there was work left to be done that is your responsibility of your job, then yes, you should have stayed, but no, not job abandonment. You didn't quit your job and not show or call or anything. That's job abandonment. If you left at 7 and had no more responsibilities to take care of, then you need to ask you boss where the problem is. If not, then it is on you.

Most Job Situations:
If your scheduled on the closing shift, your expected to stay until everything is done and everyone is ready to leave.
When I have worked retail in the past, I would be on the schedule to leave at 10 pm but since we had to deal with customers and make sure the entire store is clean and had to leave with everyone at the same time I would sometimes be at work until 11 or 12.
You will have to look up your locate state laws to find out if that would be cause for termination. Call your locate employment office for more information

go back and read the fine print of your job description, i'm sure it explains that u have to stay longer than ur scheduled time frame to handle things not taken care of in the regularly scheduled hours. if that's the case, then it is job abandonment.

Technically, you must check out with the next level manager before you leave. Times scheduled to you are a base to begin from. While an employer can not force you to work longer than your scheduled time, they can fire you for leaving without notifying your boss. If the work was promised for the customer early that next morning.. by you or you were notified your boss might have a case against you because there is no one else to get the job done on time.

ONLY IF U HAVE ANOTHER PERSON THAT HAS TO COME IN TO WORK AFTER U AND U LEAVE AND THAT PERSON DOESNT GET THERE WHEN U ARE OFF YES BUT IF U LEAVE AT THE TIME U ARE OFF NO. IF SOMEONE HAD TOLD U TO DO SOMETHING BEFORE U LEAVE AND DONT LEAVE UNTILL U FINISH WELL YES! OF COURSE IS CALLLED NOT ABONDONMENT BUT NOT FINISHING URE TASK BUT U ARE RIGHT.

Well most companies require you to ask a manager/boss if it is ok to leave early, and if you don't clear it with management, you get in trouble. And since you had to work till 7, you had to stay till 7 even though the store closed 30 min before that, and it happened that someone came in after 6:30.....thats why ur in trouble

No, If you are scheduled to be off work at 7pm you get off at 7pm unless you offer to stay. But thats on you not your employer

It appears that you have already answered your own question. You must work that hours scheduled or make prior arrangements with the management; otherwise it will be seen as abandonment. If you do loose your job, it will have been a hard lesson learned.
