Try to get them to request this in writing. Once you have enough evidence of age discrimination, find an attorney interested in taking the case. Shouldn't be a problem. AARP might be of assistance. Clever ways of geeting this in writing would be to email them questions that force them to make a choice based on age (or other discriminatory characteristic). Emample:
Dear Boss,
I would like your advice. I have two candidates: Lisa, who's 25 and Mary, who is 55. both say they have completely flexible schedules. Mary has a little more experience, but Lisa seems more energetic.
Your insight and experience are welcome.
Three or four of these emails where the "big boss" discriminates is about all you need for a $1 million settlement and life-time employment at Walmart. |

As bad as that sounds it happens quite often in big corporations and it shouldn't because it is against the law.
But if you go against the Big Bosses you'll eventually loose your job too. If there's no union there is no one that is gonna
protect your rights and there's hardly any union companys anymore, so there ya go. I guess you can start writing them up for anything you can find. |

HONESTLY!!!
Tell them you need to review their availibility. Tell them you need them to work nights (or the opposite of whatever shift they usually work). Once they refuse tell them they don't fit into the company scheduling.
You can't fire someone for no reason but if there is no NEED for them at a certain time then it should be okay. And if they talk amongst themselves about their availibilities and they bring it up to you then you can fire them on the terms of discussing private matters with other employees.
Should work just be careful you don't have someone looking for a problem.
