Yes it is legal for the company to make cuts so that they do noth ave to lay off a bunch of people. Don't worry, though. Obama and his minions are wanting the govt to control the industry and economy. One day soon. employees will be in charge and not the owners of the company. Until then, either be thankful you have a job or quit. |

A company can legally cut pay, vacation days, less employee benefits "at will." Employees don't have the right in these areas. Some people consider it's better than being laid off. Your company might be trying to keep everybody employed by cutting 15% of pay instead of having to lay off a bunch of people. |

I would be willing to accept a 15% pay cut in order to save the company anf keep my job. But I would like a promise they will restore wages when the economy improves.
Because unemployment is a lot more than a 15% cut and in a recession getting another job is very hard. But you do have the right to go looking for another job.

You have a right to sue and recover the lost wages. Unfortunately, unless you happen to be making millions of dollars with each pay check, it isn't wise to sue. Let's say your last paycheck was $1,000, and now you get $870. So you sue for that $130, and the court system will reward you $130 in general damages, because the employment payment terms modification was not met with any like consideration (a legal thing), and because the change violates the statute of frauds (another legal thing). You go out, drink a few beers, and deposit the hundred remaining bucks. You feel like a winner, and you are, for now. You go back to work Monday and they lay you off as a legal trouble maker. They have the legal right to do that too, for nothing more than economic reasons. They say sorry, bye, and you're collecting unemployment and looking for a new job.
So you see, breaking the law sometimes does pay off. Your employer is doing it to you right now. |
