Is it illegal for employees to tape meetings that their bosses are having without the knowledge of their boss?

FT
I don't think there's any law prohibiting this because the last time I checked my professor didn't give me consent to record him but I do every week. In the workplace under those conditions it is unethical and most likely against your employee code of conduct so be prepared to get fired.

MLE
Yes it is illegal for anyone to tape anyone else without their prior knowledge.

sf_omega
Yes. In most (if not all) states, it is illegal to tape any audio discussion between two individuals unless it has been expressly communicated that either party may be taping the conversation.

I would recommend talking to your HR representative and seeing what you can do to correct the situation without taking actions into your own hands.

Bob

Yes.

Nick

Yes it is indeed, as you do not have consent from the 3rd party...

Yes. If the meeting is about proprietary company stuff, or if it is government stuff, one could be in for a long jail term. And the legal cost are horrible!!

i think so

It is illegal to record a video of someone if they don't know or do not give permission for someone to do so.

Just Google It!

Yes, illegal unless some kind of release or contract referring to it was signed by the people being taped.

That could get a lot worse than just "illegal"...if the bosses were discussing something about their company or product, that could get really messy.

liberal_60
Recording conversations without the consent of all participants is a crime in many states.

In Oregon for example:
Or. Rev. Stat. "165.540. Obtaining whole or part of communication"

"(1) Except as otherwise provided in ORS 133.724 or 133.726 or subsections (2) to (7) of this section, a person may not:"
*****
"(c) Obtain or attempt to obtain the whole or any part of a conversation by means of any device, contrivance, machine or apparatus, whether electrical, mechanical, manual or otherwise, if not all participants in the conversation are specifically informed that their conversation is being obtained."

Check the link below if you want to verify the quote. The potential punishment is a fine of up to $1,000 and spending up to one year in the county jail.

You really should talk with your lawyer before you do this. There are lots of people claiming that it is OK to do this, but none of them are citing any sources. Be careful!

If you are now using the "company computer" to post this
message. You will soon find out. Invasion of privacy. <|:-{(-{*

That would likely depend on local (State/provincial) or federal laws where you live.

Generally speaking, taping a conversation that YOU are part of AND know that the taping is happening, is OK.

(A case a few years ago went against the Dad. He knew his phone conversations in his house were being taped but his daughter or wife - I can't recall which - did not know. So conversations between the unsuspecting daughter or wife and whoever they were speaking to was unknown to both parties of the conversations)

Taping 3rd parties without their knowledge/permission is clearly illegal. I'd also imagine that even if you tried to fall back on the *generally* permissible option above (again subject to your laws) and especially if it happened at the work place and/or during work hours I'm certain it's be grounds for immediate dismissal .

illegal for sure, unless a man's life is at stake and the taping is the only solution to prove Innocent

Bigdreamboy90
Ask your local council or the Local Authority for the help on things like 'what's illegal and what's legal ? stuff things etc..."
it helps,
or
if you are BRAVE enough, just ask your BOSS.

FEISTY ASIAN GIRL
i guess why? are you trying to get proof or something?

kurosaki-kun
Laws like that can vary by state. Most likely it is not illegal to tape it but illegal to use it. Either way though, you would almost definitely be breaking some kind of company policy and doing something that could get you fired.

Yes, it is legal!!

Cereal Killer
That law is on a state level, not federal. Depends on where you live.

i think it's legal as long as you are not going to use it against them in court. (if it goes to court, i'm pretty sure you have to have permission to tape them.) but it still doesn't sound ethical, so you may get in some trouble at work at the very least.

yodah20
No, it should not be illegal as long as you do not use that material to harm them. Unless they are talking about something illegal and you want to report it to the cops.

camper_velorium
NO.

WhatGodMade
I don't think so. I think it's only illegal if they expressly ask you not to videotape.
