A company I recently applied to states that if employees are late to company daily meetings, they will have their paycheck docked $25 dollars. Also, they claim they will cut your commission if customers choose to pay by credit card rather than cash/check. These seem illegal to me... |

Like everyone else said, commissions are at the mercy of the employer. They can choose how to administer the commissions. But a company cannot simply dock an employee's pay. They don't have to pay you for the time you were late, but they cannot take a flat $25 from anyone who is late. For instance, if you make $10 per hour and you are a half hour late to one daily meeting, your company can "dock" your paycheck $5. Employers only have to pay you for the time you are actually at the job (regardless of whether you are paid on an hourly or salary basis). Definitely call your labor board and see if your area has any other special provisions for this situation. |

Why would that be illegal. If your not at work they dock you yup sounds correct. The credit card thing is because your company gets hit with fees in that instance so they make less and you get less commission. |

An employer can't legally do this unless the employee signs an employee contract in the beginning of employment which states the terms. You would have to sign a document and receive a copy of it. This company seems very unethical and should be checked out. I wouldn't work there. |

If you work for commission, then they can do what they want. Its not like you have not been warned in advance. If they did it without telling you that this would happen, thats different. |

If an employee is late for work, yes, that employee can be fired. Generally, there would be a pattern of repeated behavior and several write-ups or warnings, before an actual termination. Some states have labor laws that require some sort of warning. Some times not. However, they are required to pay you for your time worked. I can't see how they can take a set amount out for being late. Maybe if you are salary. As for as the commission goes, yeah, they can pay you more or less based on form of payment recieved. Usually, they would say you get a "bonus" if they pay with cash or check. Not the other way around.
Check with your states local labor laws.

Yep, they can "dock" pay or take away pay. Why? Since you are to be on time and when a person is not on time, why would that employer pay that employee for the time he or she was not there. So, if a person is 30 mins late, 30 mins-no pay.
No, it's pretty legal. Be on time. Period. |

my employer just took 75$ out of my check after taxes. i am a barber and get paid a rate per service. these so called penalties resulting in fines on check are not in any of our handbooks nor a contract. the fine said for being late and out of uniform dont even know how much was for either. can they do this? |
