It's the bank that actually allows the cheque to be cashed....and no, they cannot cash a cheque before the date on it.
If this has happened talk to your bank, they're at fault and need to be made aware of their mistake.
P.S. In Canada it's NOT illegal to write a post-dated cheque. It does not mean you don't have the money in your account, just that you don't want it taken out until a specific date. |

No. Technically it is illegal ( not a major crime lol) to write one. Sometimes, a pd check will be deposited too soon, and if the bank doesn't catch it, then it's cashed (or bounced). Sorry. Remember..you shouldn't have cut it to begin with. |

Actually, I have heard that it is illegal to write a post-dated check, because you are presumably writing a check for funds you do not have. Corporations can cash post-dated checks if they want to. Usually they don't even notice that the date is in the future. |

Yes and the money will be withdrawn from the check's account, even if the date on the check is post dated. If you do not trust our answer, you can call your bank. Your bank will tell you that the date is only used as a reference and that it is only out of courtesy for people not to cash checks before the date posted on the check. There is not a formal rule or policy against it. |
