1. It doesn't matter if its a "multi million dollaer company" or a small business.
2. The store manager is acting in accordance with the law, unless the actions are deemed to create a hostile work environment. If you believe that may be the issue, you should contact the Department of Labor.
3. As stated earlier, contacting the company's Human Resources department would be the best first step in handling the situation internally. However, unlike a previous post, there is no "guarantee" that this will solve the issue.
4. Regardless of the legality, it isn't ethical or right. |

check with your human resources dept. to get a copy of their equality policy. You have legal rights and you don't need to tolerate being talked to in a way you find demeaning.
Depending on what the boss said it may be in black and white within the staff policy that they violated your rights, but even if not, you still have equality rights both by law and within your company.
You can surf online too to find out what your rights are for your area according to state and federal agencies - if your company doesn't have policies in place to cover these things, they are also in violation of the law solely for that, as well as for violating your right to be respected in the work place.
Even if you decide to not take legal action I would strongly recommend you make a confidential report on what happened with personnel/human resources for future reference. Be sure they will not speak with your boss about the incident without you knowing, giving your name to the boss, without your consent, and that they do not try to create a reconciliation meeting between you both unless you are VERY satisfied by them that your rights will be protected -and- you will not receive bullying as a result. By law you can ask for these conditions to be satisfied.
Do not speak with this to your immediate superiors or your colleagues for your own protection and because you can be counter sued for liable as well as harrassment and bullying! Also keep a log of any further incidents - but be wise about it: record these things at home when your shift ends etc. Hope this helps. |

There is not necessarily any Legal action you can take but you can definitely call corporate and let them know about the situation. I guarantee you that they would deal with him. |
