I don't believe so but you should check with your companies handbook. There are specific rules about how many breaks they have to give you and what the maximum number of hours you can clock in for in a single day.
Is it ethical? No. Hours should either be given to another employee and evenly distributed or hire holiday staff. |

Most people don't realize this, but an employer can change an employee's hours as they see fit in most cases in most states. While they can't technically force him to do it (slavery is illegal), most jobs are at will. Meaning an employee can be terminated for almost any reason or can quit for any reason at all. |

no, you can work your 8 hours. anything after that is on a voluntary request. You have the right not to work over 8 hrs. they can't do anything

I dont think they can. They might try to justify it as a split shift, but still. i think the maximum hours a person can work in a day is 12. but the state laws may vary. |

Unless the employee is a MINOR, there are no labor laws that govern the length of the work shift. So it is legal. That would be a signal to me to find another job.
Wal-Mart works their managers to death, and even they don't require anyone to work a 17 hour shift.
And although I admire your optimism, don't be surprised if Circuit City isn't around much longer after Christmas. You heard it here first. |

It depends on the state.. but it doesn't sound legal to force someone to work a double.. its usually a matter of choice.
Regardless, I would say that he should talk with them and tell them he will quit on the spot if they try to force the issue.
It doesnt sounds like he exactly need that job on his resume... and if he does, he can explain the situation to potential future emplyers |

legally, no. But, our working system is so messed up that most retailers break laws like this and get away with it every second. You are right in the fact that it is not only morally wrong, but legally too. But, no cop or lawyer in the world has what it takes to go up against a large retailer with all of their high priced lawyers to get them off. Right now, it is simply how the system works. This would be a perfect time to not honor the two weeks though. |

It's a bit ridiculous. I think with the 4 hour break it's legal but it is really rude of them... However if he didn't ask off I don't know if he can do anything about it. |

That doesn't sound legit at all.. I would have him talk to a manager and get that checked out. If he asked for it, it would be different, but just to force him to, that is not right. |

Yes, it is legal. As long as he is not a minor companies can work you anytime without break. The only thing they actually have to give you is the opportunity to use the bathroom. They can't tell you no on that one. Most companies just choose to be a little more humane than that. |
