Is it legit to have a manager say to an employee "We need more color in this place" ?
We all feel a bit uncomfortable around this new manager.he told an employee that " This place needs more color" referring to the employees. He looks at us and tries to make us feel inferior. He has taken most of us off the schedule for over two weeks now. We also noticed that a speaker system that was installed in the store has a microphone on the side of it. As far as I am concerned that is invasion of privacy and even the public does not know this device is there. Isnt it illegal to install devices as such without notifying anyone working in the store or a customer? Additional Details We know for sure it is a microphone. The company that was there to install it confirmed it after an employee noticed it on the side of the speaker. I am new to California so I am not sure of the laws pertaining to things like this. The microphone was installed the day I went in for my interview because I saw the guys in stalling it which was Oct 14th. Since then the manager of that store was terminated shortly after that the employee noticed the microphone. Also this manager has even sent his parents in to walk around the store to see is anyone is talking about him. Its hard enough being a military wife struggling to find employment in every state we get stationed in and then I end up with something like this.
firstly, a shop owner can put whatever he likes in a store. almost all stores have a small placard by the entrance that states that they may be recording you via audio/visual surveillance. this means that there is no reasonable expectation of privacy. if you don't believe me, look up the numerous supreme and appellant court precedents.
aside from that, a person can say whatever they like. if they act on it, it may be discrimination. however, thanks to affirmative action, hiring/scheduling more "minorities" is the direction that the government expects employers to err on.

It must be posted coming into the building that the customer is being recorded in any manner either audio or video.
As far as the remarks go I would report this person to the labor board of your state or to the people above him, or both.

For him to make racist comments like that is wrong. You should call human resources or a manager above him. I don't know where you are working, but I sure don't think that you can install a speaker system w/o permission. Are you sure that it's a microphone? Do you think he's listening to what you/coworkers/customers are saying? Regardless, I think it needs to be brought to someone above him.
