Additional Details thanks for all your help so far i do have a appointment with a financial avisor from the CAB is it best i stick with that one rather than go else where? can they do the same as these other companys that put you on a IVA? |

Yes you're quite right, it is an IVA. DO NOT GET INVOLVED WITH THESE COMPANIES. What they do is work out what you can reasonably afford to pay off debts. Say for example you have £100 per month. If creditor A has 50% of the total debt, creditor B 30%, and creditor C 20% offers will be written to them with £50, £30, and £20 respectively. Now if the interest that they're charging is more than that they will ask for the interest to be frozen. Year on year, that may well come to 70% of the total debt, hence the company's claims. BUT HERE'S THE CRUNCH: THEY WILL CHARGE YOU A FEE FOR DOING THIS, THE CITIZENS ADVICE BUREAU (CAB) OR CONSUMER CREDIT COUNSELLING SERVICE (CCCS) WILL DO THE SAME THING FOR FREE.
**edit** yes it will be an IVA you'll be getting involved in.
An IVA is the next step from bankruptcy and shouldn't be taken lightly. |

Yes new regulations in the UK allow for this.
But - all they do is negotiate with your debtors to get up to 75% of your debts cleared and accumulating interest frozen.
Be warned, the 75% only applies whilst you adhere to the payment agreements of the remaining 25% (or whatever is left). If you default, the debts go back to 100% and interest charged on the debt resumes.
Consolidation might not be the way forward for you. Do the Debt Review tests and see what the best course of action for you might be. |

they dont clear it, they arrange for it to be "written off". It really is a last resort and forget about getting credit for the next five years....
Also, money is never really "written off", it is just not chased. They can still ask you for it... |

yes but you should only use them as a LAST resort as having an IVA or going bankrupt can affect you getting credit for anything for years to come!

Yes, it's probably true. That's the good news.
The bad news is that if you re-pay less than you owe on a debt it will wreck your credit. In my honest opinion you might as well go bankrupt. That's is assuming that you qualify. Speak with a bankruptcy attorney and explore all of your options. Most debts can be discharged in Chapter 7 bankruptcy. (Child support, taxes, court ordered fines and student loans cannot be discharged in bankruptcy.)
I would avoid the credit counseling agencies that claim they can renegotiate your debt. I'd rather have all of my debt eliminate. (Actually, it's really best to pay your bills on time. But, if you can't pay your bills and if you don't have any choice, look into bankruptcy.)

i used the citizens advise bureau but still ended up bankrupt for one year ...... not as bad as i thought it was going to be and the csa helped with the forms i got 18k written off but if you own your house or a decent car then this route is not advisable except as a last resort gl my friend the sooner you take the first step the quicker its over with .............. i am now solvent and debt free> |

My husband has paid in full for my car and in his eyes owns the car, but I am the registered keeper so I could continue getting my no claims discount from my insurance company. Will going bankrupt affect the car situation. I need my car to get to work because I am a self-employed home carer. What other disadvantages will befall me regarding my work if I go bankrupt.
