Is my boss NUTS?
If you were an employee &you are entitled 2 have leave credits, &its NOT convertible 2 cash once un-used, if you use it regardless of how many leave you have, its LEGAL right? it is your privilege &right to use it as it is considered 2 be a benefit of every employee.lets say you leave from the office for a day, your boss got upset. U informed him, he didnt say anything, its easy for him 2 say NO if he doesnt want & I will definitely listen! but he didnt say anything so i assumed my leave was approved. he prepared a memo stating that he will ask any authorized PERSONNEL from the office to check if I was really SICK that time I was absent..Is this LEGAL? You can check on the day itself, but a week after my leave? i dont think it is necessary coz it was past already...as i know, NO COMPANY should investigate an employee as if he is a criminal ..Every employee has the right to use his/her leave credits...EMPLOYERS don't have the right to KNOW everything about what and how we use our leave.

i'm no attorney, but my basic understanding is that the company is obligated to enforce the rules the same way for all employees. if your use of leave in this circumstance was acceptable for any employee, than it must be acceptable for all employees. similarly, if it was unacceptable for any employee, it must be treated as unacceptable for all employees.

it sounds like there are four questions that need answering:

1. is leave restricted only for personal illness, or can it be used for other, non-medical needs? check with your HR department or benefits admin for the answer to this.

2. was your leave approved by your boss? this is a grey area. you advised your boss, but never got a firm commitment for or against. not good for you in that you did not get a definite answer, but not good for him either, as providing you with a definite answer is his responsibility. consider sending your boss an email asking whether the leave was approved. this gives your boss three options, all three of which can work for you:
a. he can respond in the positive, indicating the leave was approved. this gets you off the hook.
b. he can refuse to commit for or against (this would be neglect of his responsibility as your boss, and refusal to approve or deny a leave request, combined with recriminatory action after the fact, is a de facto suspension of your company benefits, which is not legal).
c. he can respond in the negative, indicating the leave was not approved. if this is his response, it's not good for you, because it means you took leave without approval, but it gives you an opportunity. at this point you can advise HR that you took your requested leave on good faith, having received no response from your manager, and believing that your manager's lack of rejection was an implied approval. advise HR that your boss did not respond either for or against until <fill in number of business days> after the requested leave date had already expired. this puts your boss on the hook for not providing a response, something that is part of his responsibility as a manager.

3. are you required to provide your boss with an explanation of your reasons for using leave? your reasons are personal, and not related to the execution of the business, making this is a personal privacy issue. depending on your local laws, your company may not be allowed to require that you provide a reason when you request leave. furthermore, investigation of your non-business related activities (as your boss has advised he plans to do) may constitute a violation of local privacy laws. this is a question best answered by an attorney.

4. were you honest with your boss? what i'm asking here is, did you tell your boss that you were using leave for personal illness? if so, was that the truth? if you were caught in a lie here, the only thing to do is fess up and promise it won't happen again, then keep that promise.

i would agree with you..sounds like a weirdo to me. although i would have been totally sure my leave was OK'd by him before i chose to use it. still..he is acting a bit crazy, maybe extreme. it was your benefit, you deserved it, and you used it. he needds to get over it and stop throwin a fit.

if you're sick, that's one thing.

if you're just taking a day off, you have to get approval first.
you are entitled to time off.
you are not entitled to take it and leave your job not done.

in the army, that's AWOL.
at a private company, it may well mean that you'll be out looking for a job.
and have to state on your next employment application that you were fired for not coming to work.

yes, they can, and do, do that.
welcome to the working world.
there are lots of folks who would be glad to have your job.
and will be there every day, on time, and be pleasant to have around the office, unlike you, apparently.

i'd suggest that you ought to go kiss his butt.
