Is my employer acting in a lawful way?
I work in a corporate restaurant in Texas. We are required to attend meetings every month that we are not paid for. We have been told it is grounds for dismissal if we don't show up. Is this legal? Also we are periodically required to work holidays such as Mother's Day in which we work upwards of 12 hours. During that time we are not allowed to sit down even to eat. We have to do that standing up while we perform our jobs. There are a couple of pregnant waitresses that shouldn't be working these hours with no breaks. Is this legal? Any help would be appreciated.
You are entitled to one 15 minute break for every 4 hours that you work and one 30 minute break for every 8 hours. The employer cannot make you work 12 hours without a break and cannot force you to attend meetings if they do not pay you for that time.
File a complaint with your state labor relations board.

Meetings are considered work. If it is required that you attend, they have to pay you.
I am not certain, but it is possible that you would be entitled to the standard minimum wage for the time spent in meetings, and not the lesser minimum paid to tipped employees.
I would reccomend discussing these issues with your co-workers, and talking about whether they or you want to take actions to reconcile them.
Regarding unpaid wages, you are certainly entitled to file a claim for unpaid wages with the US Dept of Labor (or probably your state DOL if you prefer.) If the goal is to stop the practice, it would be best if several of your co-workers filed a claim as well.
You could also speak with an attorney who sepcialises in employment law. Many of them will meet with you initially for free.

It sounds like they are taking advantage of their Employees. I'm from Texas and I have NEVER heard of a job that does not pay for meetings. That is unlawful! Yeah, write a letter and/or make a petition and have all of the employees sign it and mail it to the department of labor that was given to you above. It's not right that they are taking advantage of you guys like that and making the pregnant woman stand......that is bull crap! I hope it's not in San Antonio.......Good Luck! File a complaint. You should definately be compensated for the meetings and they are required to give breaks just like the above poster stated.
