Is selling burned CDs legal?

Yes it is. And I think there is likely to be more people out there watching than you think.

If you make CD's, you should probably just make mixes for yourself, or make them as gifts for your friends. That is illegal enough...if you are using stolen mp3s from Limewire and similar places. Plus, goodness, is there really a market for selling these when it is so easy to make them yourself? So many people have access to the internet and music burning software it seem ridiculous to pay someone else to make you one.

The exception of course is burning copies of your own music and info discs that you burned with your original ideas on them.

tom4bucs
do you have a license to burn copies -

the answer is the same -

see the kids at Ohio State who got bills for $3,000 from the
recording industry

OONTA
No. But neither is smoking pot, drinking alcohol in public, or taking a dump on your ex-girlfriend's lawn.

If it's fun, it's illegal.

I do not think its legal to sell burned cd's

resurrectionnnn
It depends. There are many variables that could dictate the answer. There is no "one correct" answer. If the material in question provides a royalty-free, public use and public redistribution license, then it may be repackaged, given away or sold as long as it does not violate any explicit restrictions provided. In most cases, if you unsure, contact the content author/owner for clarification. This is often most helpful should legal issues arise later.

Peggy K
Of course not. It's a violation of the copyright on the original CD.

No, burning Cd's is only for your own purpose. Many people sell Burned Cd's and also DVDs can face prosecution. I hope you are not one of them! Mostly in Asia they commit this crime.

No it's not legal...that's why artists make cd's for you to purchase at a store...so they get money from it..... It's like downloading music through programs like Limewire...it's illegal.... but people do it. That's why they made Napster change over so the artists were getting paid and why you can buy a legal version of Limewire and why they created things like iTunes.... that way the artists get money for their work.... unlike if you download it or rip a cd, or dvd for that matter, and make copies. You're not supposed to do that but people do and sometimes they get caught and other times they don't....but that's a chance you take when you do that.

liakenswg
If it is your material it would be legal.

Usually, though, the artist and the company representing him have copyright protection which makes it illegal to redistribute their work (especially for money). Therefore, if it isn't your creation, then it is probably illegal to copy and sell it.

Not unless the CD contains your original work. Otherwise you're infringing copyrights.

It depends on who owns the content.

For example, if I write a program for my own use and decide to sell it, I can obviously do that. If I write a book, again, I have the copyright, so I can do that.

If somebody else owns the content, you *may* be able to legally burn it, but cannot legally sell it without permission. For example, I can legally compile a mix CD of my favorite songs to play in the car (or download them to my ipod) because I paid for the music, but if I sold the cd (or even gave it away) I would be breaking the law.

A special case is certain open source software that has a license specifying you can sell it, but only for a "reasonable" fee to cover the cost of copying.

david
yes it is, but everyone does it

No, unless what is on the CD is something YOU made.
