N♂t - ♂ut - Yet | Is the company I'm working for breaking the law? |
This is a major retail store..
I am full time and they told me that I would have a minimum of 32 hours. Anything over 40 would be over time. They have me on the schedual in a few weeks for only 10 hours. Is that illegal? |

No, because even if they told you one thing, unless they're contractually obliged, they don't have to do anything. Most retailers are at will, meaning you can quit anytime and they can let you go at anytime. This also means they don't have to do anything. Sorry! I would just talk to your boss about what you can do to have more hours |

Either things are really slow, your company is hurting seriously financial, or they want you to quit.
Unless you have a written contract I would say no.
Check DOL.GOV (Federal Dept. of Labor) and call the phone number...they are surprisingly good to deal with.
Same with your State (search for Dept. of Labor) when on that site as well.
By the way, the FED GOV does not recognize full or part time hours contradictory to MrKnowItAll. They only concern themselves with overtime law which is subjective in itself. Overtime is generally not paid after eight hours either but after forty during one workweek. Certain businesses never have to pay overtime. See the links for more.

This is legal. What crime do you think they are committing? If you are an hourly employee you are just that, and they have no legal obligations to pay you for more time then they have available for you. |

I dont think it's illegal, just unfair cause they lied to you, but theres nothing you can do about it. |

No, they are within their rights.
In a retail or hospitality type business, you are essentially "on call" for as many hours as they want to give you. |

It's not illegal, but I'd be looking for a new job. Where I worked, if someone's hours suddenly dropped, that meant the managers didn't really want them anymore and hoped they'd quit. |

No. There are no "minimum" hour laws. |

Um, you want to review your written contract with them. If you have no written contract, then you were NOT hired as full time, but rather as part time. However, if you have something on paper than guarantees 32 hours a week, then they have to pay you for 32 hours a week, even if they force you to only work for 10 of those 32 hours.
Now, as far as the Federal Government goes, FULL TIME means working either 40 hours a week or 80 hours in 10 days scheduled work time. So, if they offered you "full time" at 32 hours a week - IT IS NOT RECOGNIZED AS FULL TIME BY THE FEDERAL GOVERNMENT.
Overtime is anytime a PART TIME worker works for more than 8 hours a day, or a FULL TIME worker works for more than 40 hours in a week.
Since you are a PART TIME employee, any time you work more than 8 hours in a given day, you are due overtime for those extra hours. |
