Is this a criminal business practice?
http://tech.yahoo.com/blogs/null/61440

This poor guy got an 85,000 phone bill.

Previously the company had called to tell him when his bill exceeded 100 dollars. But when it went into overdrive, they didn't bother to point it out.

Even if the mistake was mine orginally, if a company tried to rip me this way, I'd take it to court, and win.

Do businesses, particularly telecommunications, exist beyond the reach of ethical business practices, to say nothing of just legality?

There's an almost impassable gulf between what is illegal and what is unethical. Corporations in America are engaged in some of the most unethical conduct imaginable, but ALL OF IT LEGAL. Even LEGAL THEFT through punitive fines, and stuff you just forgot to read because it was buried in print so small you'd need an Electron Microscope to read it. These corporations think they own you. They are concerned only with making profits and care not how many lives they destroy or financially ruin throught there unethical behavior.
The little guy is chewed up, chewed to pieces and then spit out by a system that is almost totally whacked and out of control. There was more logic in Bedlam than in some US conglomerates.

Why is he a poor guy? Because he didn't read his contract before signing it? People need to learn to take responsibility for their actions and get out of this victim mentatlity.

BTW, the phone company already reduced his bill, and he still doesn't want to pay. It's people like this that drive up costs for those of us who are responsible...

Well, it probably isn't illegal. My guess is he will take it to court and get it lowered anyway. But lotsa laws are like this... I mean technically downloading one song illegally can cost upwards $750, and most have hundreds, if not thousands of songs...

The bill was actually reduced to $3,243.

Is this criminal, no. Cell phone contracts are very detailed. The user may not have understood the contract or read the fuill contract, but the cahrges would have been explained somewhere in his user agreement.

As any fees would have been discussed in his contract, the 85,000 bill is perfectly legal.

It is not ethical, especially if they had a previous history of cutting off the user if he was 100 over his limit, but it is legal.

I think the company realized that this amount was not ethical, especially if the user did not understand the fees (and the company also wanted to avoid negative publicity and a potential lawsuit), which is why the bill was reduced.

If the fees were not explained in the contract, then this would be a criminal practice.

Basic tenet of law : Caveat Emptor = Buyer beware

It's not up to the supplier to be the guardian of the consumer.

Why is this company trying to rip him? He used it, so he should pay for the use. And next time read the SMALL print!!
