Lauren R | Is this discrimination, legally, do you think? |
I was hired as a PT 4 years ago. At that time I was told it might be "a year or two" before they could make me full time. I work for a newpsper as a platemaker. I average 32 hours; 2 other ladies in my department are FT and were there when I came. The press room is all full time all men. They recently downsized and now some of them work in the mailroom, for the same pay w/benefits even though they are not in the pressroom.
Here's the problem: I got an OK from my super to work some xtra hours in the mailroom and was doing this long before the pressroom was downsized. Now I'm told I can't work 40 hours--that it must be under 32. And yet they have me work the vacations/sick days for the other plateroom employees, so I have worked as much as 65 hours in one week.
I feel that because they are allowing the pressmen to work in the mailroom for 40 hours, they should do this for me too. One pressman says no because I was hired PT. But essentially the pressmen have BECOME pt. Right? Additional Details It's not about the hours, it's why cant I be allowed to get up to 40 hours. The pressmen who were downsized are PT now essentially no matter HOW they were hired. And it's like they're all men and as the ONLY women in the department wh ycan't I be treated the same as them. thankx! |

Contact an attorney in your area that specializes in Employment Law. Most will be glad to speak with you on the phone or meet with you in person to discuss the merits of your case. Also, generally there is no charge for initial consultations. They will probably need to do some research to decide if your case has merit and will then get back to you. |

I agree with the other people that answer your question...unfortunately more and more companies do the same all over the US |

It does not sound like discrimination. It sounds like they are avoiding having to give you benefits. Companies are not required to offer benefits to part time employees, but you can't be considered a part time employee if you work too many hours. While I'm sure it varies by state, 32 hours is a common number. |

This is all about whether the Newspaper wants to pay you benifits or not. If you are full time they have to give you benifits but as long as they can keep you part time then they don't have to pay you benifits. |
