Just need to know?
lets say 2 companies have the same name and their both big
in their areas lets say 2 ice cream stores... same title
both big..how do they decide who gets to keep the name?

I say it depends on how much ice-cream they sell in a period of time. Whoever has a higher sale they should get to keep the name.

If both places are in NJ, then during the registration process of the business the business registrar for lack of a better word should have picked up on the fact that the name was taken. If one of the business' i s afranchise then the franchise business should get the name.

If each business is in a different state, their is not much to be done unless you in corporate and then apply to do business in othe states. One place could be using a DBA, Doing Business AS, or a TA, Trading As.

More information is needed to fully answer this question.

Aslo f no one has copy righted the name then fair game to use elsewhere. Burger King is Copy righted and opnlythe BK Corportaion can use it.
