My Gym is Drawing on Expired Debit Card (legal)?
Quick data points:
1 )Opened gym membership in 2003 using debit card to draw month dues (both GYm and Bank are in California)
2) Debit card expired August 2005
3) I was under the assumption that if the debit card expired the gym could not charge my account
4) I just checked my bank account and realized the gym has been putting through my credit card every month (post expired date)
5) I never cancelled my membership thinking that my expired debit card would accomplish this like other services that don't allow you to continue to receive services with an invalid credit card

Questions:
Do I have any recourse?
if yes, Gym, Merchant Provider or my Bank

Please send links.........

P.S. I should have formally sent a termination letter back in '05, but, I did not.......and I'm a moron for not doing so, BUT, an answer to my questions is much appreciated

Jason2944 reiterated what BofA told me. Well there goes $2K. Maybe for good measures I should spend another $500 by filing a claim against BofA at the local courthouse forcing BofA to hire a local attorney to show up and represent BofA. Just think this could cost BofA at least $2k in retainer fees. Thanks, Jason2944

just because a card is expired, charges may still appear on it.

monthly pre-authorized debits, such as gym memberships, monthly internet fees, etc. are still "authorized" on the actual card number.

when a card expires, usually the card number will remain the same. if not, it's generation (gen code) will change - which is usually the last three digits.

ideally, a lost/stolen card would change the card number competely and force all pre-authorized debits to hit a stolen debit card number and that could stop them.

or one thing you could do is ask your bank to submit a cancellation on a pre-authorized debit. if it's the same amount monthly, a "block" could be placed on it. if the amount changes though, it could still go through.

so the recommended option is to speak with your gym. review the original contract as far as cancelling membership is concerned. but beware, even cancelling it may incur some steep fees.

in addition, stay a little more up-to-date on your bank statements. it can't hurt to just stay up to date on your finances.

Sounds like the card is still attached to your account. Just because it expired does not change the account number for an automatic withdrawal. You should have terminated your membership because they still have access to your bank account.

Did you renew your expired card and do they bare the same number as the old one if you have renewed?

If so, then they have the right to charge your card since you did not officially write in to cancel your membership or ask the bank to stop payment and the new card is still valid.

Call the gym and play dumb.. and be really nice.. they may reduce some of the charges... then send the letter to them to make it formal.... Because technically you owe that money.

As far as the Bank... crappy bank.. who is it BofA ... Wells?? anyway. I would raise a bunch of crap for that.. they can't just keep accepting the charges.. what's the point of expiring a card? What if the card is stolen.. and it's expired.. they still accept charges? NO.... The bank needs to fix it and I would not settle for anything less. That's unacceptable. The bank took it upon themselves to pay it.. so they can pay it!!!

The gym , no. They had every right to continue charging.

The bank, it depends on your contract with them. The fact that an expiration date on a card passed does not mean the account expired. Gyms usually put these charges thru the ACH system, not the card. Chances are these charges are all valid charges.

Hate to say this but, I think you answered your own question when you said, I'm a moron for not doing so...
