I do not think it is legal for him to ask THAT question. It might be legal for him to ask more specific questions relating to the effects of your medication on performing particular job duties. For example, my mother is bipolar, and some of her medications carry warning labels that they might impair one's ability to drive or operate heavy machinery. If part of your job requires the operation of heavy machinery, he might be allowed to ask if your medication could impair your ability to safely operate the machine, or if you FEEL that your medication could impair YOUR ability to perform required duties.

As far as I am aware they only have the right to now the illness itself. I am Bipolar I myself and all my employer knows is that I am Bipolar, I am on medication, and that I am dealing with it professionally... and that I am not a threat to myself or anyone else.
As long as you are able to complete the tasks of your position there is no problem. According to the ADA the employer must actively find a position or accomodate your position (to a certain percentage). They can not just fire you and they can not delve into your file in such a way. Best answer to give them is.... Ask my doctor if he can tell you, he will. tell your doctor you do not want that informtion shared.

I think that would be confidential medical information. It would have to be kept seperate from your personnel file. Your boss has no right to ask.

No, that is not your employer's business. If your boss writes you up, you'll have a claim, if you want to pursue it.

p.s. J&C H (below) - You've never heard of "bi-polar"?! It's a legitimately diagnosable condition. As the saying goes, better to keep your thoughts private and let people *think* you're ignorant than to put your thoughts out there and remove all doubt.
