My employer offers a profit sharing bonus, says there is no profit this year, and won't show the books...?
Is there a way to see the numbers legally?

tom_gpp
If there is a written Profit Sharing Plan it is required by law that the books be turned over to participating employees.

Chipmonk...You are quite incorrect. These plans are written plans and ARE required to be turned over to employees upon written request (standard language in any agreement).

However, there truly may be no profit this year and he may be embarrased of the financial position of the company.

Good luck

Chipmonk...You are right in the fact that there is a lack of information. I am using the assumption that there is a formal Profit Sharing Plan in place. Most business owners will use a boiler plate programa nd not truly understand it. I can't begin to tell you how many clients I have walked into to do an IB package and that is the first thing that has to be cleaned up. If there is no formal plan in place then you would be correct.

Read your employee handbook. You should be able to find your answer there. Good luck!

Sorry, but it really is none of your business and I can see where this is going.

Employers are not required to give bonuses, vacations, sick leave or holiday pay. They are all considered "gifts or incentives."

They are ONLY required as per the Dept of Labor to pay you for the time you worked.

So consider yourself lucky to have a job.

If your employer has offered the bonus to you as part of the incentive package you got when you were hired then yes, he will have to show you the books, however, it may take you getting lawyer to make it happen.

In the Kitchen
Unless you actually put your own money into the company, I would think not.
