Yes, the company is liable. Even if they correct the situation now, you should start looking elsewhere for a job. You don't want to work at a place that is having financial trouble.
Secondly, you can explain the situation to the bank. About half the time, the bank will refund the overdraft fee.

Yes. Explain the situation to HR and show them the fee. If they refuse to pay it you should probably start looking for another job. The small claims court fee would cost you the same amount as the cancelled check fee.

Liable, yes. But will they pay is the question. When a company is in bad shape it does all it can to make payroll. If they cannot make payroll then they have virtually no money and are on the brink of bankruptcy.

If pay checks bounce they probably don't have a hr team. You can take them to court.
But what I would do is just steal something from them.
