Most people presented with the news story about Wal*Mart vs. Debbie Shank share a strong opinion in favor of the Shanks.
Of course they (Wal*Mart) has a legal right to collect, is it ethical?
But the company officers and board of directors seem to be exercising their powers to act on this.
The negative publicity has had cost them so much more.
So assume you are the CEO of the company...
Would you stand your position as they apparently are doing, or would you do something else? |

I would write this one off. However, there is one GLARING problem with the one-sided 60 minutes story: Her LAWYER collected nearly half a million dollars off of this case, but they failed to anticipate the problem with the Wal-Mart right to seek reimbursement based upon a judgement.
Anyone ever heard of lawyers committing malpractice? Her lawyers committed malpractice by not sealing that crack for her.
As for Wal-Mart: they should write this one off and pay the reimbursement amount ($200 K?) to the health insurance company to cut their losses (in goodwill and lost sales) over this. |

As the CEO of Wal Mart, I would go back to the corporate philosophy and mission statement that made them the PIGS they are today.
Treat your employees, neighbors and customers fairly with good service, American made products, at competitive prices.
Do you recall when Wal Mart use to brag that all it's products were made in America? Ha. They mere made in China, shipped to an American sea port, trucked into Mexico where the product was placed in it's packaging for retail sales and then the "Made in America" tag was placed on it, then trucked back into the USA for sale in your local area. Now everything in Wal Mart comes from China, to include the meats you purchase.
Do you have any idea how many concessions Wal Mart requires to come to a town near you? Tax breaks, subsidies, impact fees that they demand from the local and county government. Then once they fling open the doors, the employees need major assistance from your States Econmoic Security department. All in the name of $PROFIT$.
Weighing all the facts as reported in the media I would ask myself and my board of directors, what would be the benefit or negative impact if we pursued this matter legally? what are all the costs? Is it ethical? Maybe, Morally? No.
This is something the CEO and the executive group did not consider with much thought. After court costs (paying wally worlds legal beagles for recovering Debbie's money) and negative publicity which would sting for a few days before Wal Mart quashes the media by threatening to pull advertising revenue from them.
As the CEO I would have allowed the Shanks to retain the monies. Or if the board over rode my decision I would get one of the several Wal Mart or Walton family endowments or grants to step up to the plate to help this family.
Wal Mart always wants concessions where ever it wants to do business, but they never seem to really want to give back to the communities or the country that made them what they are today. Corporate Pigs!

I dont know anyone who could take money from a brain damaged mother of a son who died to protect this country in Iraq and able to sleep at night it should be against all morals Walmart made 90 bil last year do they desperately need 400,00 more my little sis has a form of retardation and its just hard for me to understand how anyone could do this |

If I was the CEO I would have thought ahead and saw an opportunity to make Walmart look like it cares.
1) I would have objected to suing her. Of course, it is a sentimental case, so there are bound to backlashes!
2) I would have called and informed the heartless Walton kids (who have the money solely 'cause of Sam, minus him, they would have been just average joes!!), and asked them to seize the occassion to donate the money. The Shanks themselves would have made a positive appreciation and encouraged people to shop there.
3) If the corporation would have still not agreed, then listening to my conscience, I would have donated myself. After all, the CEO makes ridiculous bonuses!! This way I would get good sleep and my children would not look down on me as a heartless bastard!
4) If 'cause of my action Walmart would have fired me, so be it. God is the supreme Commander, not Walmart.
Least to mention, that their 18 years old son perished serving us. Could I sleep in peace? Mr. CEO, you made a bad judgement. So what if legally the courts agreed? You hurt a poor family but now the feel the heat !!!!!!!! |

Not knowing how Walmart's legal department works I think I would write this one off but I don't think the publicity will hurt them for long. Bottom line I don't think it hurts because in the long run more people are concerned with their own welfare despite the best intentions. |
