Should I be entitled to a free gift card or something?
So I ordered two shades online at JCPenney.com in mid-october. Both came, and one, however labeled the correct color, wasn't the right color on the inside. So I had to drive an hour away to an actual store to return it, and reorder the correct one. They gave me my tax back for my benifit, I think. Now as nearly a month has passed since the reorder, I called to check on the status of the replacement shade. Turns out UPS damaged the shade, threw it away and didn't do anything about it. It's in JCP's records, but no reorder or refund has been given to me. I'm about to call JCP back and ask if there has been any new plan of action as to when I'm gonna get my shade.
Now, I don't want to be a pain or anything, and I want to do the right thing But I'm irritated and I want my shade, and I kinda want my money back too. Or at least a free gift card or something. Should I ask? Am I entitled to anything here?

I would talk to a supervisor. The Customer service person that answers the phone probably won't be able to help you. Since you had to drive soooo far, at the very least you are entitled to a significant discount or store credit. Have you checked the JCP website? Most websites have customer feedback areas. I would tell them how I feel! If JCP won't do anything for you, the best thing to do is never purchase a thing from them again. I'm sure you can find another company on-line or locally that wants your business.

I hope you ordered using a credit card. Call JCP and tell them you want to cancel the order for the second shade. Get it cleared. If they won't cancel it tell them you want the replacement shipped immediately and will dispute the charge on your credit card if not recieved in 10 days. It's JCP responsibility to get the goods to you in satisfactory condition not UPS.

It's up to JCP to give you a gift card but don't count on it. Get the mess cleared up to your satisfaction before you go asking them for a free gift card.

First of all, I wouldn't mention that they "gave you the tax back" cause that's sort of illegal. They probably just ate the cost of the tax. Secondly, they won't give you anything for your trouble unless you ask. You have to be firm but not overly rude and tell them that this has been a huge inconvenience and that you think they should compensate you in some way. It will probably work.

Take a stand! If it wern't for the consumers, the store wouldn't exist. Whether it be a $2 product or a $2,000 product, you are entitled to what you payed for. Good luck!

You should be entitled to a lot of things. Whatever you find that you want the most (giftcard and/or money back) just go after it. Make JCP look as bad as possible and talk to a manager of some sort, and also, remember to make it as dramatic as possible. If you decide to do this, you should get something.

You are absolutly entitled to something... getting the shade free or a gift card like you said. You have been MORE then patince. Due to your diligence you are making the m follow throug. You know after that shade was damaged they weren't going to send another unless you followed up on it. Good for you! Good luck!

It sounds like you had some really bad service and bad luck!!I would definately try to get something from them. Whether it be a gift card, a discount on the next order or free shipping on the next order you place. Good luck!!

It doesn't take much for most companies to be willing to give you a refund because the situation was so inconvenient. Call them, and don't yell and curse and stuff, but make it obvious that you're annoyed. Tell them you're very disappointed by the service that you have received and that you think that they should be doing something about it because you've been a customer there for some time and your opinion of the company is going to be changing drastically because this was handled so poorly. If they aren't taking you seriously enough ask to speak with a manager. If they feel like they are going to be risking loosing you as a customer, they assume that you will probably be telling your family and friends and they don't want to have a bad reputation because they will lose business. What's the worst that could happen, they could say no? Good luck and I hope you get your money back!

STOP! Now I'm about to give you FREE customer service advice. Nothing is FREE or should be expected to GET ANYTHING FREE in life. You either pay for it or earn it. Mistake number one: if you are only 1 hour away from JCP, why didn't you go and shop for the product where you can lay your hands on it to begin with? Lazy I'd say. Secondly, when the product is picked up by a carrier (UPS, FedEx, DHL, Post Office, etc.) the responsibility transfers to the carrier to get it there in one piece. The SELLER fulfilled its obligation by packing it up and shipping it, for a fee I might add. Unless UPS can prove it was packed incorrectly or not according to UPS specifications, your complaint and claim is between YOU and the SHIPPER. JCP is out of it. When the shipper reimburses you for the damaged product, get in your car, drive the 60 miles and buy what you need. On-line buying can be a bad experience and I think you have just found that out. Now to answer your question: NO you are NOT ENTITLED to a FREE gift card! The only entitlement you have is FREE AIR because even health and fortune you have to EARN. Didn't your parent teach you that?
