Told at work if employee's talk to anyone they have to stay 10 minutes extra, is this fair ?
A person i know is working for Zuni, which use to be Virgin Megastore. They where told by their employer that if they where caught talking to other members of staff or the public and the conversation wasn't work orientated they would have to work an extra 10 minutes that day, further more if they did not do this, 10 minutes would be deducted from their monthly pay check. It sounds horrible wrong, can Zuni treat employee's like this ?

Zuni wants you to work for the time they are paying you for. They are not paying you to stand around and talk (about non work oriented things). Is this legal? don't know. Is this fair? It's fair for Zuni, but not for the employee. Not much you can do (unless it is deemed to be illegal) except find new employment.

Basically, so long as no-one challenges the employer, they can enforce pretty much what they want.

I doubt very much that this policy would be upheld at an employment tribunal, but who's going to go to tribunal over 10 minutes (probably minimum) wage?

Darren
I'm guessing you're Irish.
Me too! =D
But no, I highly doubt it is.
Unless it's in their contract of employment.
Which I would also highly doubt.

What if you continue to do your job as you talk?

Companies don't have to be fair because it is their company especially if you live in a commonwealth state. They do what they want and make up their own rules as they go along with no one to report them to.The dirty south.

There's always the difference between 'fair' and 'legal' to consider. Is it fair? Of course not. Under UK law (I assume you're in the UK, yes?), it may perhaps be legal, but my suspicion is that it is not. Ultimately, I have no answer for you without researching the relevant laws (or even knowing which laws are relevant).
