brian | WHO TO SUE USPS or UPS? |
Hi i went to a ups store to ship a laptop and talked to the person on the register. the guy recommended that we send the laptop via usps priority mail since they were teamed up in the store and it was cheaper to send the laptop. We dont have any tracking # or insurance since we were not offered and did not know about the service. The laptop was lost and now the two are pointing fingers. who should i sue? can i sue usps even though it is government operated? or is it the ups fault? i will accept any suggestions. thanks |

I doubt you can sue anyone since you did not insure it. The priority mail tracking number will be on your receipt. If you don't have a receipt you can not even prove you mailed anything. |

You can't sue either one. Unfortunately, it is your fault that you did not request insurance or any type of tracking number. If you had shipped UPS, you would have better recourse as all packages automatically have tracking numbers and any item valued over $100 would have had insurance suggested by the computer system. The UPS stores only offer USPS shipping as a courtesy. When shipping a high dollar item, you ALWAYS insure it.
Your best bet is to probably talk to your credit card company. Many cards have some sort of protection for this type of thing and may cover your loss if you purchased the laptop on your credit card.
If you went to an actual UPS store, talk to the owner. Those stores are ALL operated by franchise owners so I'm not even sure that the corporate UPS managers would even get involved with this situation. If they can show that the package was picked up by USPS, they have no additional liability. |

Im sorry but you cannot sue usps or ups.
Insurance and delivery confirmation are options offered by USPS. If they were not offered is not an excuse, there is not much you can do, you cannot sue anybody.
How was it shipped, priority mail or first class, if it was first class it may be on its way. I've shipped a lot of stuff and never had any problems it may be delayed, or sitting at the post office where it was delivered, go check or give them a call.

YOU did not request a tracking number. YOU did not request insurance. You are the one responsible for not taking advantage of these options, so there is no-one to sue. Plus, I think you would have to have proof of sending the package, and its contents. |
